2.4 SUMMARY OF REVISED/SUBSEQUENT DISPOSAL<br />

DECISIONS<br />

In or about October 1996, the <strong>Tustin</strong> <strong>City</strong> Council approved the MCAS<br />

<strong>Tustin</strong> Reuse <strong>Plan</strong> and subsequently amended the <strong>Plan</strong> in September 1998.<br />

On January 16, 2001 the <strong>Tustin</strong> <strong>City</strong> Council certified the Final<br />

Environmental Impact Statement/Environmental Impact Report<br />

(FEIS/FEIR) for the Disposal and Reuse <strong>of</strong> MCAS <strong>Tustin</strong> and adopted<br />

General <strong>Plan</strong> Amendment 00-001 which incorporated into the Reuse <strong>Plan</strong><br />

land use designation into the General <strong>Plan</strong> for that portion <strong>of</strong> MCAS<br />

<strong>Tustin</strong> within the <strong>City</strong> <strong>of</strong> <strong>Tustin</strong>. The Department <strong>of</strong> the Navy published<br />

its Record <strong>of</strong> Decision (ROD) approving the FEIS/FEIR as the<br />

environmental documentation for the disposal <strong>of</strong> surplus federal property<br />

at MCAS <strong>Tustin</strong> on March 2, 2001 and approving the Reuse <strong>Plan</strong>, as<br />

amended.<br />

Following an extensive review <strong>of</strong> the <strong>City</strong> <strong>of</strong> <strong>Tustin</strong>’s Economic<br />

Development Conveyance (EDC) Application and other requests for<br />

property at MCAS <strong>Tustin</strong>, the Department <strong>of</strong> the Navy approved the<br />

conveyance <strong>of</strong> only a portion <strong>of</strong> <strong>Tustin</strong>’s requested EDC properties and<br />

approved additional properties that were not originally included in the<br />

EDC Application. Conveyance <strong>of</strong> property to the <strong>City</strong> <strong>of</strong> <strong>Tustin</strong> was<br />

<strong>of</strong>ficially approved with the execution <strong>of</strong> an Agreement Between the<br />

United States <strong>of</strong> America and the <strong>City</strong> <strong>of</strong> <strong>Tustin</strong>, California for the<br />

Conveyance <strong>of</strong> a Portion <strong>of</strong> the Former Marine Corp Air Station <strong>Tustin</strong><br />

(The “Navy Agreement”) dated May 13, 2002. The Agreement provided<br />

for the phased conveyance <strong>of</strong> approximately 1,153 acres at the former<br />

MCAS <strong>Tustin</strong> as shown on Figure 2-3(b) and located within the <strong>City</strong> <strong>of</strong><br />

<strong>Tustin</strong> and all utility systems at the former facility (within both the <strong>City</strong> <strong>of</strong><br />

<strong>Tustin</strong> and <strong>City</strong> <strong>of</strong> Irvine jurisdictional boundaries) and certain personal<br />

property items. The Navy Agreement also identified parcels that the Navy<br />

would auction to private developers (identified as Government Parcels on<br />

Figure 2-3b). Following conveyance <strong>of</strong> the EDC property from the Navy<br />

to <strong>Tustin</strong>, the Agreement has the following results with respect to other<br />

agencies and their original LRA recommended or denied requests for<br />

property.<br />

A. <strong>City</strong> <strong>of</strong> <strong>Tustin</strong><br />

1. The Navy will convey directly to <strong>Tustin</strong> all <strong>of</strong> Parcel 1 (a<br />

previous Department <strong>of</strong> Education request).<br />

2. The Navy will convey directly to <strong>Tustin</strong> all <strong>of</strong> Parcel 19 (a<br />

previous Department <strong>of</strong> Education request).<br />
