Chapter 4 • Specific <strong>Plan</strong> Administration<br />

B. Purpose<br />

An interim use contributes to the continued productivity <strong>of</strong> the land even<br />

though it is not intended to be permanently part <strong>of</strong> the development<br />

pattern. Some interim uses are a continuation <strong>of</strong> uses similar to existing<br />

uses at the time <strong>of</strong> plan adoption and will eventually phase out. Others<br />

may be established in the future to respond to certain site conditions (e.g.,<br />

toxic clean up), <strong>of</strong>fset operations and maintenance costs, capture<br />

worthwhile market opportunities, or allow for an incremental transition to<br />

a permanent use.<br />

C. Requirements:<br />

1. Authority - The <strong>City</strong> and Federal authority under which the<br />

interim use operates must be documented as part <strong>of</strong> the approval<br />

records (if different from or in addition to the general authority<br />

contained in the Specific <strong>Plan</strong>).<br />

2. Time Limit - Establishment <strong>of</strong> an interim use shall be<br />

accompanied by a time limit (which may be extended) or a<br />

description <strong>of</strong> the circumstances under which it is intended to be<br />

replaced by a permanent use.<br />

3. Clean Up - Adequate provisions shall be included in the approval<br />

<strong>of</strong> any interim use so that the property will either be returned to<br />

its original condition or that it will otherwise be discontinued in<br />

such a way that there is no impediment to subsequent use <strong>of</strong> the<br />

property in accordance with this Specific <strong>Plan</strong>.<br />

4. Bonding - Sufficient bonding or security shall be in place to<br />

assure that all obligations <strong>of</strong> maintenance and discontinuance <strong>of</strong><br />

the interim use can be met.<br />

5. Existing Uses - Existing uses which are not identified as<br />

permanent uses under this Specific <strong>Plan</strong> may continue until they<br />

are replaced by a permanent use or superseded by approval <strong>of</strong><br />

another interim use. Existing interim uses shall be subject to<br />

requirements <strong>of</strong> this Specific <strong>Plan</strong> and provisions <strong>of</strong> the <strong>Tustin</strong><br />

<strong>City</strong> Code or Irvine <strong>City</strong> Code, as applicable, regarding<br />

protection <strong>of</strong> the public health, safety and welfare where not<br />

superseded by the Federal Government. This may require<br />

improvements not now in place on the part <strong>of</strong> interim uses as<br />

surrounding uses develop.<br />
