iiiiiiivvcarry out appropriate site investigations to the satisfaction of CRCL and thelocal authority to determine the extent and type of contaminants present onthe site;identify potential sources, pathways and receptors and the risk of harm toreceptors;liaise with the local authority and the Environment Agency to address theirreasonable requirements and agreeing control or protection measuresnecessary for dealing with identified risks;obtain any necessary licences for the storage, treatment and disposal ofcontaminated material (including dewatering discharge);ensure that removal and disposal of contaminated materials complies with astrict consignment note system and that delivery is to appropriately licenseddisposal facilities.B8.2.2B8.2.3B8.2.4B8.2.5B8.2.6B8.2.7Existing track ballast shall be handled in accordance with the Network Rail standardfor ‘Used Ballast Handling’ (NR/SP/ENV/044). Any other contaminated materialencountered shall be dealt with in compliance with best practice and statutoryguidance, for example the Control of Substances Hazardous to Health (COSHH)Regulations and through the Construction (Design and Management) (CDM)Regulations 2007.If contamination that has not been previously identified and is encountered on site,no further development shall take place (except to the extent that would not disturbthat contamination) until a site investigation is carried out in accordance withparagraph 8.2.1.The guidance in HSE Protection of Workers and the General Public during theDevelopment of Contaminated Land 1991 and the DEFRA Helping to Prevent theSpread of Invasive Non-native Species Horticultural Code of Practice March 2005shall apply in so far as this is applicable to the construction works and whereappropriate suitable measures shall be implemented to minimise risks.Appropriate precautions must be taken if materials containing asbestos areencountered. The contractor shall comply with the Control of Asbestos Regulations2006 and the Approved Code of Practice ‘Work with Materials Containing Asbestos’L143 (2006) and observe the guidance set out by the HSE in publications including‘Asbestos: The Licensed Contractor’s Guide’ (HSG 247), ‘Surveying, sampling andassessment of asbestos-containing materials’ (MDHS 100), and Medical SeriesGuidance Note MS13 Asbestos (2005).In order to mitigate the effects during piling and earthworks it will be ensured thatthe techniques employed in construction are suitable to prevent new pathways beingcreated at this stage.Imported fill materials will be tested to ensure that they are suitable for use in termsof chemical quality prior to placement.ENVIRONMENTAL RESOURCES MANAGEMENTB-30CHILTERN RAILWAYS
