(d) Requirement to File Amendment Applications<br />

Certain Forest Service conditions contemplate unspecified long-term<br />

changes to project operations or facilities for the purpose of mitigating<br />

environmental impacts. These changes may not be implemented without prior<br />

Commission authorization granted after the filing of an application to amend the<br />

license. These conditions are listed below.<br />

<strong>Draft</strong> Article 4xx. Large Woody Debris Management Plan. Within 1 year of<br />

license issuance, the licensee shall develop the large woody debris management plan<br />

specified by U.S. Forest Service condition no. 29. The plan shall focus on feasible<br />

options to the practice of burning woody debris removed from Hell Hole reservoir with a<br />

preference for placement of large woody debris within the active channel of the Rubicon<br />

<strong>River</strong> downstream of Hell Hole dam. The plan shall include: (1) a description of<br />

alternatives considered; (2) an analysis of the environmental benefits and costs of each<br />

alternative considered; (3) reasons for rejecting any alternatives; (4) a schedule for<br />

implementing recommended option(s); and (5) provisions for monitoring and reporting<br />

on the results of large woody debris management at the Hell Hole development.<br />

The plan shall be developed in consultation with the U.S. Forest Service,<br />

California Department of Fish and Game, and the California State Water Resources<br />

Control Board. The plan filed with the Commission shall include documentation of<br />

consultation with the agencies, copies of comments and recommendations on the<br />

completed plan after it has been prepared and provided to the agencies, and a specific<br />

description of how the agencies’ comments are accommodated by the plan. The licensee<br />

shall allow a minimum of 30 days for the agencies to comment before filing the plan with<br />

the Commission. If the licensee does not adopt a recommendation, the filing shall<br />

include the licensee’s reasons, based on site-specific information.<br />
