The Commission reserves the right to require changes to the plan. Upon<br />

Commission approval, the licensee shall implement the plan, including any changes<br />

required by the Commission.<br />

<strong>Draft</strong> Article 4xx. Streamflow and Reservoir Elevation Gaging Plan. Implement<br />

the Streamflow and Reservoir Elevation Gaging Plan required by U.S. Forest Service<br />

condition no. 31 and filed with the Commission on September 6, 2011. In addition, the<br />

licensee shall include in the annual monitoring reports filed with the Commission, in<br />

accordance with section 5.0 of the plan, the daily average, minimum, and maximum<br />

streamflow and reservoir elevations.<br />

<strong>Draft</strong> Article 4xx. Annual Report on Status of Reintroduction of Endangered<br />

Species Act-Listed Species. By December 31 of each year following license issuance, the<br />

licensee shall file with the Commission a report on the status of reintroduction into the<br />

<strong>American</strong> <strong>River</strong> watershed of Endangered Species Act-listed species. The report shall:<br />

(1) include a discussion of the steps that have been taken to assist in the reintroduction<br />

process; (2) provide a summary of the results of any studies that have been undertaken to<br />

benefit the reintroduction effort; and (3) discuss the status of any reintroduction<br />

programs.<br />

The licensee shall prepare the report and all components after consultation with:<br />

the U.S. Department of Commerce-National Marine Fisheries Service; the U.S.<br />

Department of the Interior-Bureau of Reclamation; U.S. Department of the Interior-Fish<br />

and Wildlife Service; and California Department of Fish and Game. The licensee shall<br />

include with the report documentation of consultation, copies of comments on the<br />

completed report after it has been prepared and provided to the agencies and specific<br />

descriptions of how the agencies’ comments are accommodated by the report. The<br />

licensee shall allow a minimum of 30 days for the agencies to comment and to make<br />

recommendations before filing the report with the Commission. If the licensee does not<br />

adopt a recommendation, the filing shall include the licensee’s reasons, based on projectspecific<br />

information. The Commission reserves the right to require changes to the<br />

reporting requirements.<br />

<strong>Draft</strong> Article 4xx. Reservation of Authority to Prescribe Fishways. Authority is<br />

reserved to the Commission to require the licensee to construct, operate, and maintain, or<br />

to provide for the construction, operation, and maintenance of such fishways as may be<br />

prescribed by the secretaries of the Interior and Commerce pursuant to section 18 of the<br />

Federal Power Act.<br />

<strong>Draft</strong> Article 4xx. Vegetation and Integrated Pest Management Plan. Implement<br />

the Alternative 1 Vegetation and Integrated Pest Management Plan filed with the<br />

Commission on November 30, 2011, and required by U.S. Forest Service condition no.<br />

46 with the following revision: provisions to include the entire French Meadows<br />
