3. PHASE I TESTING<br />

This may include air, soil <strong>and</strong>/or water sampling at the site. This testing may also include subsurface soil <strong>and</strong>/or water.<br />

The sampling shall determine what pollutants are present at the site <strong>and</strong> their concentrations. Testing of the samples shall<br />

be per<strong>for</strong>med by a laboratory that is technically qualified to per<strong>for</strong>m such work <strong>and</strong> listed, as such, by the DEC.<br />

a) Where directed by the Assistant Commissioner Infrastructure Design the Consultant shall engage the <strong>services</strong> of a<br />

firm, that has been listed by the Department of Environmental Conservation (DEC) as being qualified to per<strong>for</strong>m such work,<br />

to develop the scope of work <strong>for</strong> a Phase I Testing Program <strong>for</strong> the project site.<br />

b) The Consultant shall develop the testing program in con<strong>for</strong>mity with the <strong>requirements</strong> of any regulatory agency that<br />

has jurisdiction over such operations <strong>and</strong> shall submit his/her proposals to <strong>and</strong> meet with representatives of such agencies,<br />

as necessary, to ensure compliance with their <strong>requirements</strong>.<br />

c) The Consultant shall submit the proposed scope of work <strong>for</strong> Phase I Testing <strong>and</strong> a proposal <strong>for</strong> conducting the<br />

testing program to the Commissioner <strong>for</strong> approval.<br />

d) Upon approval of the Phase I Testing program by the Commissioner, the Consultant shall, using the <strong>services</strong> of the<br />

DEC listed firm <strong>and</strong> accepted laboratory, conduct the approved testing program.<br />

e) The results of the testing shall be presented in a report to the Commissioner. The report shall detail the procedures<br />

employed during the field investigation <strong>and</strong> the field observations made; shall evaluate the technical data obtained; <strong>and</strong><br />

indicate the nature, concentration <strong>and</strong> location of any contamination detected <strong>and</strong> the possible sources of such<br />

contamination. The report shall indicate, specifically, one of the following:<br />

i) A finding of no contamination;<br />

ii) A finding of minor contamination which poses no significant threat to health or the environment;<br />

iii) A finding of potential significant threat to health or the Environment.<br />

f) The report shall indicate the need <strong>for</strong> site remediation <strong>and</strong> <strong>for</strong> additional testing; the extent of remediation needed; <strong>and</strong><br />

shall present <strong>and</strong> discuss procedures <strong>and</strong> methods that should be used to accomplish such remediation.<br />

4. SPECIFICATIONS FOR SITE REMEDIATION<br />

Where directed by the Commissioner, the Consultant, using the <strong>services</strong> of the DEC listed firm, shall develop <strong>and</strong> provide<br />

the Commissioner with specifications <strong>for</strong> site remediation work that are to be included in the proposed construction<br />

contract. The specifications shall include procedures <strong>for</strong> removing, storing, monitoring, testing, <strong>and</strong> disposal of<br />

contaminated materials; <strong>and</strong> <strong>for</strong> protecting workers <strong>and</strong> the public from contamination during construction operations.<br />

4.15 STREET DESIGN, INCLUDING STUDY AND DESIGN OF STREET GRADES, STUDY AND DESIGN<br />

OF STREET DRAINAGE, PERMANENT STREET SIGNS AND PREPARATION OF GRADE<br />

CHANGE EXHIBIT<br />

1. Under this task the Consultant shall study <strong>and</strong> <strong>design</strong> street components <strong>and</strong> appurtenances; incorporate the<br />

various <strong>design</strong> elements developed under the other tasks included in the Specific Requirements of this Contract; prepare<br />

Preliminary, Pre-Final <strong>and</strong> Final Contract Documents incorporating other agencies <strong>design</strong> work, including the obtaining of<br />

comments/approvals <strong>for</strong> submissions that are complete with specifications, estimates <strong>and</strong> other ancillary items; <strong>and</strong> that<br />

are ready <strong>for</strong> bidding.<br />

2. This Street Design Task is the basic <strong>design</strong> element of the Final Design Program that is to be executed under this<br />

Contract. Under the Street Design Task the Consultant shall coordinate the technical details of all the tasks included in the<br />

Specific Requirements, including (a) Study <strong>and</strong> Design of Street Grades, (b) Study <strong>and</strong> Design of Street Drainage <strong>and</strong> (c)<br />

Permanent Street Signs into the street <strong>design</strong>, <strong>and</strong> consolidate them into one unified, Bid-Ready Contract Document. The<br />

Consultant shall not proceed with work on any Final Design Task without prior written approval from the Commissioner.<br />

3. In studying <strong>and</strong> <strong>design</strong>ing the street elements, appurtenances <strong>and</strong> other appropriate elements of this project the<br />

Consultant shall:<br />

a) Be responsible <strong>for</strong> expediting <strong>and</strong> advancing the development, approval <strong>and</strong> acceptance of the final schematic<br />

<strong>design</strong> in con<strong>for</strong>mity with the project objectives.<br />
