EXHIBIT G: REQUIREMENTS FOR FEDERAL AID PROJECTS<br />

This Exhibit only applies if the Project is a Federal Aid Project.<br />

The Consultant is advised that the Project is a Federal Aid Project. The City of New York, Department of Design <strong>and</strong><br />

Construction (―DDC‖), is receiving funds from the United States Government <strong>for</strong> construction of the Project.<br />

Specifically, funding <strong>for</strong> the Project is being provided by the Federal Highway Administration (―FHWA‖).<br />

(1) Opportunities <strong>for</strong> DBEs: Since the Project is a Federal Aid Project, the Consultant is required to provide the<br />

maximum possible contracting opportunities <strong>for</strong> Disadvantaged Business Enterprises (―DBEs‖). The Consultant<br />

must use its best ef<strong>for</strong>ts to af<strong>for</strong>d DBEs the maximum practicable opportunity to participate in the Project. The<br />

DBE Program is a federally regulated program that is administered by the New York State Department of<br />

Transportation (NYSDOT).<br />

DBE Utilization: The Consultant is required to use its best ef<strong>for</strong>ts to achieve the level of DBE utilization<br />

set <strong>for</strong>th in Exhibit A.<br />

Certified DBEs: When offering DBE participation, the Consultant is responsible <strong>for</strong> ensuring that all of<br />

the proposed DBE subconsultants are certified through the New York State Unified Certification Program<br />

(NYSUCP) <strong>for</strong> the type of work they are being proposed to per<strong>for</strong>m. The certification must be in effect on<br />

the RFP response date. The NYSUCP DBE Directory is located at: http://biznet.nysucp.net/<br />

(c) Compliance: For the Department to periodically monitor compliance with DBE <strong>requirements</strong>, the<br />

Consultant <strong>and</strong> subconsultants shall submit in<strong>for</strong>mation utilizing the civil rights reporting software<br />

Equitable Business Opportunities (―EBO‖).<br />

(d)<br />

Provisions <strong>for</strong> DBE Participation: The Consultant shall comply with Provisions <strong>for</strong> DBE Participation,<br />

attached to this Exhibit as Appendix A-4.<br />

(2) Revisions to the Contract: If the Project is a Federal Aid Project, the Contract is revised as set <strong>for</strong>th below.<br />

Article 6.1.3: Article 6.1.3 is revised as set <strong>for</strong>th below.<br />

6.1.3 Procedures: The Consultant shall ascertain the st<strong>and</strong>ard practices <strong>and</strong> procedures of the City prior<br />

to the per<strong>for</strong>mance of <strong>services</strong> required by this Contract, <strong>and</strong> all such <strong>services</strong> shall be per<strong>for</strong>med in<br />

accordance with these st<strong>and</strong>ard practices <strong>and</strong> procedures. In addition, the Consultant shall be familiar with<br />

the Federal Process. The Consultant shall comply with all procedures <strong>and</strong> <strong>requirements</strong> <strong>for</strong> federally<br />

funded projects, as directed by DDC, including without limitation, (a) procedures <strong>and</strong> <strong>requirements</strong> <strong>for</strong><br />

monitoring, reporting <strong>and</strong> record keeping, <strong>and</strong> (b) procedures set <strong>for</strong>th in NYSDOT Procedures <strong>for</strong><br />

Locally-Administered Federal Aid Projects (Exhibit H).<br />

Participation by M/WBEs: Any <strong>requirements</strong> <strong>for</strong> participation by M/WBEs are deleted.<br />

(3) Required Provisions: Since the Project is a Federal Aid Project, the following appendices, attached to this<br />

Exhibit, are included as provisions of the Contract.<br />

(b) Appendix A-2: Required Federal Provisions <strong>and</strong> Certifications<br />
