3.4 Import regime<br />

This section summarises the findings of the evaluation on the CPHR performance to date, taking<br />

into consideration EQ 7 (area C) of the ToR.<br />

EQ7. How is current import regime implemented by Member States, how effective is it and<br />

what are its critical success factors?<br />

The effectiveness of the current import regime, as implemented by the MS, is examined by<br />

analysing the following elements:<br />

Notifications of interceptions;<br />

Efficacy of the system in dealing with non-compliance;<br />

Cooperation with Customs and consistency and interoperability of nomenclature and IT<br />

systems;<br />

Functioning of the reduced-frequency checks system for imports of end products;<br />

Functioning of the system of derogations, including derogations for scientific and<br />

breeding material;<br />

Use and usefulness of the additional declaration on the phytosanitary certificate and of<br />

Annex VI of the base Directive;<br />

Functioning of identity and PH checks at the place of <strong>final</strong> destination (PoD) instead of<br />

the point of entry (PoE) and fulfilment of minimum requirements at the PoE;<br />

Need for further development of electronic certification;<br />

Need for measures addressing passenger transport;<br />

Need to enforce capacity building in TCs;<br />

Effectiveness of emergency measures.<br />

A description of the current import restrictions and requirements relating to the import of plants<br />

and plants products is provided in Annex 1 (Theme 2).<br />

3.4.1 Analysis of notifications of interceptions<br />

In case of interceptions of material non-compliant with plant health requirements, as laid down<br />

in Article 13c(8) of Directive 2000/29/EC, the responsible official body shall inform the<br />

Commission and the NPPO of the third country of origin or consignor country, within two<br />

days 109 , via a notification to the EUROPHYT system. This common database is being used for<br />

the notification/storing of all data regarding interceptions in the normal trade flow. The reason<br />

for the interception must be provided, including for example incomplete formalities or the<br />

detection of HOs. The Commission may then study the case with a view to taking measures to<br />

prevent further similar occurrences.<br />

The following Figures and Tables present an overview of the notifications as recorded in<br />

EUROPHYT to date. EUROPHYT records notifications of interceptions both at import point and<br />
