that Chamber’, <strong>the</strong> assignment of a judge to a<br />

particular divisi<strong>on</strong> may have implicati<strong>on</strong>s for <strong>the</strong><br />

extensi<strong>on</strong> of <strong>the</strong>ir mandate. This, in turn, may<br />

have significant budgetary c<strong>on</strong>sequences for<br />

<strong>the</strong> Court. Notably, as discussed in greater detail<br />

in <strong>the</strong> ASP – Electi<strong>on</strong>s secti<strong>on</strong> of this <str<strong>on</strong>g>Report</str<strong>on</strong>g>,<br />

<strong>the</strong> six Judges whose terms will end in March<br />

2012 could all have <strong>the</strong>ir mandate extended<br />

given that <strong>the</strong>y are currently serving <strong>on</strong> <strong>the</strong><br />

bench of <strong>on</strong> <strong>on</strong>going trial 331 and <strong>on</strong> <strong>the</strong> Appeals<br />

Chamber. 332 A judge whose mandate has been<br />

extended <strong>on</strong>ly serves in that capacity for <strong>the</strong><br />

limited purpose of <strong>the</strong> extensi<strong>on</strong> and no l<strong>on</strong>ger<br />

participates in <strong>the</strong> plenum of judges.<br />

The SGG focused specifically <strong>on</strong> two questi<strong>on</strong>s<br />

regarding judges’ mandates. The first related to<br />

<strong>the</strong> discreti<strong>on</strong> of <strong>the</strong> President to temporarily<br />

attach a ‘pre-trial judge’ to <strong>the</strong> trial divisi<strong>on</strong><br />

and vice versa. 333 The sec<strong>on</strong>d c<strong>on</strong>cerned <strong>the</strong><br />

assignment of judges to a particular divisi<strong>on</strong>.<br />

Judges are assigned to a particular divisi<strong>on</strong> of<br />

<strong>the</strong> Court, ie pre-trial, trial or appeals divisi<strong>on</strong>, 334<br />

Trial Divisi<strong>on</strong> of not less than six judges and <strong>the</strong> Pre-Trial<br />

Divisi<strong>on</strong> of not less than six judges. The assignment of<br />

judges to divisi<strong>on</strong>s shall be based <strong>on</strong> <strong>the</strong> nature of <strong>the</strong><br />

functi<strong>on</strong>s to be performed by each divisi<strong>on</strong> and <strong>the</strong><br />

qualificati<strong>on</strong>s and experience of <strong>the</strong> judges elected to <strong>the</strong><br />

Court, in such a way that each divisi<strong>on</strong> shall c<strong>on</strong>tain an<br />

appropriate combinati<strong>on</strong> of expertise in criminal law and<br />

procedure and in internati<strong>on</strong>al law. The Trial and Pre-Trial<br />

Divisi<strong>on</strong>s shall be composed predominantly of judges with<br />

criminal trial experience.’<br />

by <strong>the</strong> plenary of judges for a period of three<br />

years, with <strong>the</strong> excepti<strong>on</strong> of an appointment to<br />

<strong>the</strong> appeals divisi<strong>on</strong>. 335<br />

Pursuant to <strong>the</strong> SGG’s request, <strong>on</strong> 23 June 2011,<br />

<strong>the</strong> Presidency submitted an informati<strong>on</strong> note<br />

to <strong>the</strong> SGG <strong>on</strong> <strong>the</strong> practices of <strong>the</strong> Presidency<br />

relevant to <strong>the</strong> compositi<strong>on</strong> of Chambers. In <strong>the</strong><br />

informati<strong>on</strong> note, <strong>the</strong> Presidency set out <strong>the</strong><br />

factors relevant to <strong>the</strong> compositi<strong>on</strong> of Chambers,<br />

including <strong>the</strong> divisi<strong>on</strong>al compositi<strong>on</strong>, <strong>the</strong> l<strong>on</strong>gterm<br />

needs of <strong>the</strong> Court, <strong>the</strong> workload and<br />

appropriate representati<strong>on</strong>, and <strong>the</strong> need for<br />

potential extensi<strong>on</strong>s of mandate. 336 Additi<strong>on</strong>al<br />

factors include gender and geographical balance<br />

of a particular Chamber, <strong>the</strong> representati<strong>on</strong> of<br />

<strong>the</strong> principal legal systems and <strong>the</strong> appropriate<br />

experience and expertise (eg a balance between<br />

List A and List B judges). 337 The Presidency noted<br />

that <strong>the</strong>se factors are assessed <strong>on</strong> a case-bycase<br />

basis and <strong>the</strong> assessment cannot always be<br />

carried out in public. However, <strong>the</strong> Presidency<br />

stressed that ‘even where a justificati<strong>on</strong> for a<br />

given compositi<strong>on</strong> might not be easily discernible<br />

to outsiders, it always results from a detailed<br />

assessment and balancing of <strong>the</strong> above factors,<br />

guided by <strong>the</strong> overarching objective of ensuring<br />

<strong>the</strong> efficient management of <strong>the</strong> Court’s<br />

workload’. 338<br />
