c<strong>on</strong>taining preliminary lists of pers<strong>on</strong>s from<br />

both <strong>the</strong> pro-Gbagbo and pro-Ouattara sides<br />

that appeared to bear <strong>the</strong> greatest resp<strong>on</strong>sibility,<br />

‘including those who ordered, financed and<br />

o<strong>the</strong>rwise organi[s]ed <strong>the</strong> alleged crimes’. 1018<br />

The Prosecutor’s request for authorisati<strong>on</strong> to<br />

open an investigati<strong>on</strong> detailed several incidents<br />

of rape and sexual violence experienced by<br />

<strong>the</strong> civilian populati<strong>on</strong>. The Prosecutor stated<br />

that <strong>the</strong>re were at least 100 reported cases of<br />

rape but that he expected <strong>the</strong> total number of<br />

rape incidents to be higher. 1019 In particular, <strong>the</strong><br />

Prosecutor asserted that sexual violence was<br />

most prevalent al<strong>on</strong>g ethnic and/or political<br />

lines, and that victims were often told by <strong>the</strong>ir<br />

aggressors that <strong>the</strong>y were being punished for<br />

<strong>the</strong>ir ethnicity and/or political affiliati<strong>on</strong>s.<br />

The Prosecutor’s request stated that <strong>the</strong><br />

elements of admissibility and interests<br />

of justice were satisfied in this case. 1020 In<br />

regards to complementarity, <strong>the</strong> Prosecutor<br />

acknowledged that domestic investigati<strong>on</strong>s were<br />

being c<strong>on</strong>ducted into crimes in Côte d’Ivoire,<br />

but asserted that <strong>the</strong>re were no domestic<br />

investigati<strong>on</strong>s or proceedings pending against<br />

those pers<strong>on</strong>s bearing <strong>the</strong> greatest resp<strong>on</strong>sibility<br />

for <strong>the</strong> post-electi<strong>on</strong> crimes that fall within <strong>the</strong><br />

jurisdicti<strong>on</strong> of <strong>the</strong> ICC. 1021 The Prosecutor cited<br />

<strong>the</strong> letter of President Ouattara to him, dated<br />

3 May 2011, setting forth that ‘<strong>the</strong> Ivorian<br />

judiciary is not at this stage in <strong>the</strong> best positi<strong>on</strong><br />

to address <strong>the</strong> most serious of <strong>the</strong> crimes’ that<br />

have been committed since 28 November 2010,<br />

individuals may face multiple obstacles’. 1022<br />

Significantly, <strong>the</strong> Justice Minister, after <strong>the</strong><br />

announcement of preliminary investigati<strong>on</strong>s by<br />

President Ouattara <strong>on</strong> 27 April 2011, specified<br />

that <strong>the</strong> investigati<strong>on</strong> excluded crimes falling<br />

within <strong>the</strong> jurisdicti<strong>on</strong> of <strong>the</strong> ICC. 1023<br />

On 6 July 2011, Pre-Trial Chamber III issued<br />

an order to <strong>the</strong> Victims Participati<strong>on</strong> and<br />

Reparati<strong>on</strong> Secti<strong>on</strong> (VPRS) 1024 c<strong>on</strong>cerning victims’<br />

representati<strong>on</strong>s pursuant to Article 15(3) of <strong>the</strong><br />

Statute. 1025 The Chamber requested <strong>the</strong> VPRS to<br />

provide a report of <strong>the</strong> representati<strong>on</strong>s received<br />

from victims. The Chamber emphasised that in<br />

order to have <strong>the</strong> Article 15 proceedings carried<br />

out efficiently, <strong>the</strong> VPRS should undertake an<br />

initial prima facie assessment ‘to ensure that<br />

<strong>on</strong>ly those representati<strong>on</strong>s emanating from<br />

sources who are potentially victims within <strong>the</strong><br />

meaning of Rule 85 of <strong>the</strong> Rules [of Procedure<br />

and Evidence] are sent to <strong>the</strong> Chamber for<br />

c<strong>on</strong>siderati<strong>on</strong>, within <strong>the</strong> c<strong>on</strong>text of <strong>the</strong><br />

Prosecuti<strong>on</strong>’s present applicati<strong>on</strong>’. 1026<br />

On 29 August 2011, after <strong>the</strong> request for<br />

an extensi<strong>on</strong> of time had been granted, <strong>the</strong><br />

Registry submitted <strong>the</strong> c<strong>on</strong>solidated report <strong>on</strong><br />

representati<strong>on</strong>s received from victims from<br />

Côte d’Ivoire. 1027 The report gave an overview<br />

of <strong>the</strong> 1038 representati<strong>on</strong>s received by <strong>the</strong><br />

<strong>the</strong>ir property which is dedicated to religi<strong>on</strong>, educati<strong>on</strong>,<br />

art or science or charitable purposes, and to <strong>the</strong>ir<br />

historic m<strong>on</strong>uments, hospitals and o<strong>the</strong>r places and<br />

objects for humanitarian purposes.’<br />
