Trust Fund for Victims<br />

The missi<strong>on</strong> of <strong>the</strong> Trust Fund for Victims (TFV) is to support<br />

programmes that address <strong>the</strong> harm resulting from <strong>the</strong> crimes<br />

under <strong>the</strong> jurisdicti<strong>on</strong> of <strong>the</strong> ICC by assisting victims to return<br />

to a dignified and c<strong>on</strong>tributory life within <strong>the</strong>ir communities.<br />

In accordance with Rule 98 of <strong>the</strong> Rules of Procedure and<br />

Evidence (RPE), <strong>the</strong> TFV fulfils two primary mandates:<br />

to implement awards for reparati<strong>on</strong>s ordered by <strong>the</strong> Court against<br />

<strong>the</strong> c<strong>on</strong>victed pers<strong>on</strong>, 83 and<br />

to use <strong>the</strong> o<strong>the</strong>r resources for <strong>the</strong> benefit of victims subject to<br />

<strong>the</strong> provisi<strong>on</strong>s of Article 79 of <strong>the</strong> Rome Statute. 84<br />

The TFV’s first mandate <strong>on</strong> reparati<strong>on</strong>s is linked to a criminal case against an accused<br />

before <strong>the</strong> ICC. Resources are collected through fines or forfeiture and awards for<br />

reparati<strong>on</strong>s, which can be complemented with ‘o<strong>the</strong>r resources of <strong>the</strong> Trust Fund’ if<br />

<strong>the</strong> Board of Directors so determines. 85<br />

Reparati<strong>on</strong>s to, or in respect of, victims can take many different forms, including<br />

restituti<strong>on</strong>, compensati<strong>on</strong> and rehabilitati<strong>on</strong>. This broad mandate leaves room for<br />

<strong>the</strong> ICC to identify <strong>the</strong> most appropriate forms of reparati<strong>on</strong> in light of <strong>the</strong> c<strong>on</strong>text of<br />

<strong>the</strong> situati<strong>on</strong>, and <strong>the</strong> wishes and views of <strong>the</strong> victims and <strong>the</strong>ir communities. Under<br />

<strong>the</strong> general assistance mandate, <strong>the</strong> TFV promotes victims’ holistic rehabilitati<strong>on</strong><br />

and reintegrati<strong>on</strong> where <strong>the</strong> ICC has jurisdicti<strong>on</strong> in three legally defined categories:<br />

physical rehabilitati<strong>on</strong>, psychological rehabilitati<strong>on</strong> and material support. 86<br />
