significant factor’ than o<strong>the</strong>r criteria. 1907 However, <strong>the</strong><br />
Registry also acknowledged that appointing existing<br />
counsel as comm<strong>on</strong> legal representative allowed for<br />
c<strong>on</strong>tinuity of representati<strong>on</strong>, which is all <strong>the</strong> more<br />
important when comm<strong>on</strong> legal representati<strong>on</strong> is<br />
applied late in proceedings, as participating victims<br />
may have established l<strong>on</strong>g-standing relati<strong>on</strong>ships with<br />
<strong>the</strong>ir legal representatives, making <strong>the</strong> impositi<strong>on</strong><br />
of new counsel ‘disorienting and upsetting for <strong>the</strong><br />
victims’. 1908<br />
In its filing, <strong>the</strong> Registry noted that it has commenced<br />
a process of establishing a ‘systematic approach’ to<br />
comm<strong>on</strong> legal representati<strong>on</strong>, which incorporates<br />
<strong>the</strong> following principles: (i) early acti<strong>on</strong> <strong>on</strong> comm<strong>on</strong><br />
legal representati<strong>on</strong>; (ii) meaningful c<strong>on</strong>sultati<strong>on</strong> with<br />
victims; and (iii) an open, transparent and objective<br />
selecti<strong>on</strong> process. 1909 The Registry did note, however,<br />
that in <strong>the</strong> present case it had ‘yet to fully realise this<br />
approach’. 1910 The filing set out <strong>the</strong> general criteria to<br />
be applied by <strong>the</strong> Registry in selecting comm<strong>on</strong> legal<br />
representatives, including <strong>the</strong> following factors: a<br />
relati<strong>on</strong>ship of trust with <strong>the</strong> victims; a dem<strong>on</strong>strated<br />
commitment to working with vulnerable pers<strong>on</strong>s; a<br />
familiarity or c<strong>on</strong>necti<strong>on</strong> to <strong>the</strong> Situati<strong>on</strong> country;<br />
relevant litigati<strong>on</strong> experience; sufficient availability;<br />
and basic informati<strong>on</strong> technology skills. 1911 In<br />
particular, <strong>the</strong> Registry emphasised that gender would<br />
be a relevant criteri<strong>on</strong> in assessing <strong>the</strong> potential of<br />
counsel to establish a relati<strong>on</strong>ship of trust with <strong>the</strong><br />
participating victim, specifically where <strong>the</strong> Registry<br />
believes that <strong>the</strong> gender of counsel would enable<br />
victims to speak frankly about <strong>the</strong> crimes experienced<br />
by <strong>the</strong>m, especially in relati<strong>on</strong> to sexual crimes. 1912<br />
Surprisingly, <strong>the</strong> Registry did not explicitly set<br />
admittance to <strong>the</strong> ICC’s List of Legal Counsel as <strong>on</strong>e of<br />
<strong>the</strong> criteria for selecting comm<strong>on</strong> legal representati<strong>on</strong>.<br />
The Registry outlined that it had taken <strong>the</strong> following<br />
steps in relati<strong>on</strong> to organising comm<strong>on</strong> legal<br />
representati<strong>on</strong> in <strong>the</strong> Kenyan cases:<br />

Selecti<strong>on</strong> criteria and <strong>the</strong> respective weight<br />
accorded to <strong>the</strong>m had been established, again<br />
taking into account <strong>the</strong> views and informati<strong>on</strong><br />
provided by victims and intermediaries as well as<br />
<strong>the</strong> Registry’s previous experience;<br />
An invitati<strong>on</strong> had been sent out to <strong>the</strong> List of<br />
Legal Counsel to elicit expressi<strong>on</strong>s of interest to<br />
represent victims in <strong>the</strong> Kenya cases; 1913 and<br />
The Registry had taken into c<strong>on</strong>siderati<strong>on</strong> <strong>the</strong> work<br />
performed by legal representatives in <strong>the</strong> case to<br />
date.<br />
Acknowledging its statutory obligati<strong>on</strong>s to c<strong>on</strong>sult<br />
with victims about <strong>the</strong> appointment of <strong>the</strong>ir counsel,<br />
<strong>the</strong> Registry noted with c<strong>on</strong>cern that it had not<br />
been able to c<strong>on</strong>sult with all victims in <strong>the</strong> present<br />
case. 1914 The Registry also acknowledged that when<br />
comm<strong>on</strong> legal representati<strong>on</strong> is decided up<strong>on</strong> prior<br />
to <strong>the</strong> acceptance of victims in <strong>the</strong> proceedings, as<br />
is <strong>the</strong> case in <strong>the</strong> present proceedings, 1915 ‘<strong>the</strong>re is<br />
a risk that victims’ views may be sidelined’. 1916 To<br />
solve this issue, <strong>the</strong> Registry explained that it had<br />
sought to c<strong>on</strong>sult with members of various victim<br />
communities throughout Kenya to seek <strong>the</strong>ir views<br />
<strong>on</strong> <strong>the</strong> issue of legal representati<strong>on</strong>. The Registry<br />
noted that ‘while this approach has its limitati<strong>on</strong>s,<br />
<strong>the</strong> Registry c<strong>on</strong>siders that it has been able to<br />
establish an understanding of victims’ preferences<br />
regarding <strong>the</strong>ir legal representati<strong>on</strong>’. 1917 The Registry<br />
acknowledged that c<strong>on</strong>sultati<strong>on</strong>s with existing legal<br />
representatives c<strong>on</strong>cerning <strong>the</strong> issue of comm<strong>on</strong><br />
legal representati<strong>on</strong>, which has been <strong>the</strong> Registry’s<br />
approach in previous cases, would have provided it<br />
with a wealth of informati<strong>on</strong> about victims’ views<br />
and c<strong>on</strong>cerns in <strong>the</strong> Kenya cases, but rightly stressed<br />
that ‘<strong>the</strong>ir input cannot replace direct c<strong>on</strong>sultati<strong>on</strong>s<br />
with victims’. 1918 Unfortunately, however, <strong>the</strong> Registry<br />
has not been able to c<strong>on</strong>duct a ‘tailored and specific<br />
c<strong>on</strong>sultati<strong>on</strong>’ with victims <strong>on</strong> <strong>the</strong> issue of comm<strong>on</strong><br />
legal representati<strong>on</strong>. In an attempt to explain its lack<br />
