command over <strong>the</strong> troops, and expressed<br />

surprise at <strong>the</strong> absence of any charges against<br />

those who did, including President Patassé and<br />

General Miskine. 1436 The Defence c<strong>on</strong>cluded by<br />

requesting <strong>the</strong> Trial Chamber to acquit Bemba.<br />

Witness testim<strong>on</strong>y<br />

From <strong>the</strong> start of trial <strong>on</strong> 22 November 2010<br />

until 16 September 2011, Trial Chamber III<br />

heard approximately 220 days of testim<strong>on</strong>y by<br />

28 witnesses, including three expert witnesses<br />

called by <strong>the</strong> Prosecuti<strong>on</strong>, who testified for a<br />

total of nine days. Am<strong>on</strong>g <strong>the</strong>se 28 witnesses, 14<br />

witnesses, including two expert witnesses, were<br />

called to testify directly about sexual violence. 1437<br />

A fur<strong>the</strong>r eight witnesses also menti<strong>on</strong>ed rape<br />

in <strong>the</strong>ir testim<strong>on</strong>y. 1438 Witnesses also testified<br />

<strong>on</strong> <strong>the</strong> use of child soldiers and <strong>on</strong> looting by<br />

soldiers of ransacked areas. In this time period,<br />

ten female witnesses testified before <strong>the</strong> Court,<br />

eight of whom were direct victims of sexual<br />

This secti<strong>on</strong> includes selected witness<br />

testim<strong>on</strong>ies given in open sessi<strong>on</strong> and made<br />

available <strong>on</strong> <strong>the</strong> ICC’s website as of 16 September<br />

2011. Extensive testim<strong>on</strong>y was given in closed<br />

or private sessi<strong>on</strong>, and <strong>the</strong> identifying details of<br />

many of <strong>the</strong> witnesses were also given in closed<br />

or private sessi<strong>on</strong>. Three witnesses testified<br />

almost entirely in closed sessi<strong>on</strong> (Witness 75,<br />

Witness 63 and Witness 169). For <strong>the</strong>se reas<strong>on</strong>s,<br />

<strong>the</strong> descripti<strong>on</strong>s of <strong>the</strong> witnesses and <strong>the</strong>ir<br />

testim<strong>on</strong>ies are necessarily limited. The secti<strong>on</strong><br />

focuses primarily <strong>on</strong> <strong>the</strong> direct testim<strong>on</strong>y<br />

of witnesses called by <strong>the</strong> Prosecuti<strong>on</strong>, with<br />

summaries of issues raised by <strong>the</strong> Defence teams<br />

and Legal Representatives of Victims included<br />

<strong>on</strong>ly where relevant. The Defence team’s<br />

arguments will be reviewed more thoroughly<br />

<strong>on</strong>ce it has presented its case at a later stage of<br />

<strong>the</strong> proceedings, al<strong>on</strong>g with <strong>the</strong> positi<strong>on</strong>s of <strong>the</strong><br />

Legal Representatives of Victims.<br />

The secti<strong>on</strong> focuses in particular <strong>on</strong> <strong>the</strong><br />

testim<strong>on</strong>y given by witnesses about <strong>the</strong> sexual<br />

violence committed by <strong>the</strong> MLC soldiers,<br />

often referred to as <strong>the</strong> Banyamulengue. The<br />

Prosecuti<strong>on</strong> called twelve crime-based witnesses<br />

who testified directly about sexual violence; at<br />

least nine of <strong>the</strong>m were direct victims of sexual<br />

violence. Ten witnesses testified about gangrape<br />

and multiple rapes. At least nine witnesses<br />

testified that <strong>the</strong> Banyamulengue were armed<br />

while committing rape and threatened <strong>the</strong>ir<br />

victims with <strong>the</strong>ir weap<strong>on</strong>s. A number of<br />

witnesses testified that <strong>the</strong> MLC soldiers did<br />

not say anything during <strong>the</strong> rapes. At least ten<br />

witnesses testified about <strong>the</strong> profound social<br />

impact of <strong>the</strong> rapes, and told <strong>the</strong> Court that<br />

<strong>the</strong>y felt embarrassed about what happened.<br />

Some also spoke about <strong>the</strong> stigma attached to<br />

<strong>the</strong> crime, which caused <strong>the</strong>ir communities to<br />

ostracise <strong>the</strong>m. At least four witnesses spoke<br />

about being aband<strong>on</strong>ed by <strong>the</strong>ir families as a<br />

c<strong>on</strong>sequence of <strong>the</strong> rape. Five witnesses testified<br />

that <strong>the</strong>y c<strong>on</strong>tinue to suffer from depressi<strong>on</strong>. At<br />

least seven witnesses testified about <strong>the</strong> rape of<br />
