Judiciary – Key Decisi<strong>on</strong>s Victim Participati<strong>on</strong><br />

Defence’s preparati<strong>on</strong>s for trial, as <strong>the</strong> most recent<br />

batch of applicati<strong>on</strong>s had been transmitted to <strong>the</strong><br />

parties in <strong>the</strong> middle of <strong>the</strong> prosecuti<strong>on</strong>’s case at<br />

trial. 1805 In particular, <strong>the</strong> Defence argued that <strong>the</strong><br />

delay in transmitting <strong>the</strong> ninth batch of applicati<strong>on</strong>s<br />

for participati<strong>on</strong> which were <strong>the</strong> subject of <strong>the</strong><br />

present decisi<strong>on</strong> had prevented <strong>the</strong> Defence from<br />

asking pertinent questi<strong>on</strong>s of <strong>the</strong> first 20 prosecuti<strong>on</strong><br />

witnesses, relating to <strong>the</strong> informati<strong>on</strong> and allegati<strong>on</strong>s<br />

c<strong>on</strong>tained in <strong>the</strong> applicati<strong>on</strong>s for participati<strong>on</strong>. 1806<br />

Acknowledging <strong>the</strong> ‘heavy burden’ <strong>on</strong> <strong>the</strong> parties<br />

caused by <strong>the</strong> transmissi<strong>on</strong> of significant numbers of<br />

applicati<strong>on</strong>s, <strong>the</strong> Chamber put in place a schedule for<br />

<strong>the</strong> filing of future applicati<strong>on</strong>s and set 16 September<br />

2011 as <strong>the</strong> final deadline for <strong>the</strong> submissi<strong>on</strong> to<br />

<strong>the</strong> Registry of any new applicati<strong>on</strong>s for victim<br />

participati<strong>on</strong> in <strong>the</strong> case. 1807<br />

The Defence also challenged <strong>the</strong> role of intermediaries<br />

in assisting with <strong>the</strong> completi<strong>on</strong> of applicati<strong>on</strong> forms<br />

for victim participati<strong>on</strong> in light of <strong>the</strong> testim<strong>on</strong>y<br />

of Witness 73, who had testified that a particular<br />

individual was working with a team of people carrying<br />

documents with <strong>the</strong> ICC logo, causing <strong>the</strong> witness to<br />

believe that <strong>the</strong>se people were ICC officials. Witness<br />

73 had alleged that <strong>the</strong> individual in questi<strong>on</strong> had<br />

encouraged applicants to fabricate or exaggerate <strong>the</strong><br />

value of pillaged items and to lie about <strong>the</strong> crimes<br />

committed against <strong>the</strong>m. 1808 The Chamber agreed with<br />

<strong>the</strong> Defence’s asserti<strong>on</strong> that Witness 73’s testim<strong>on</strong>y<br />

had cast doubt <strong>on</strong> <strong>the</strong> extent of that intermediary’s<br />

involvement in <strong>the</strong> applicati<strong>on</strong> process, and <strong>the</strong>refore<br />

deferred c<strong>on</strong>siderati<strong>on</strong> of <strong>the</strong> applicati<strong>on</strong>s completed<br />

with that intermediary’s assistance pending its receipt<br />

of fur<strong>the</strong>r informati<strong>on</strong> under Regulati<strong>on</strong> 86(7). 1809<br />

Kenya<br />

No victims have been accepted to participate at <strong>the</strong><br />

Situati<strong>on</strong> stage of proceedings in <strong>the</strong> Kenya Situati<strong>on</strong>.<br />

Pre-Trial Chamber II issued a decisi<strong>on</strong> <strong>on</strong> 3 November<br />

2010 regarding <strong>the</strong> framework for victim participati<strong>on</strong><br />

at <strong>the</strong> Situati<strong>on</strong> stage of proceedings. 1810 The Chamber<br />

held that Article 68(3) provides <strong>the</strong> normative<br />

framework for victim participati<strong>on</strong> in <strong>the</strong> absence of<br />

more specific provisi<strong>on</strong>s in <strong>the</strong> Statute. Before deciding<br />

<strong>on</strong> applicati<strong>on</strong>s for participati<strong>on</strong>, a Chamber must first<br />

determine whe<strong>the</strong>r and to what extent <strong>the</strong> Situati<strong>on</strong><br />

stage may qualify as a ‘stage of <strong>the</strong> proceedings’ for<br />

<strong>the</strong> purposes of Article 68(3), and must <strong>the</strong>n determine<br />

(i) whe<strong>the</strong>r <strong>the</strong> relevant stage is ‘appropriate’ for <strong>the</strong><br />

purposes of victim participati<strong>on</strong>, and (ii) whe<strong>the</strong>r <strong>the</strong><br />

pers<strong>on</strong>al interests of <strong>the</strong> victims are affected. 1811 The<br />

Chamber will <strong>on</strong>ly c<strong>on</strong>sider <strong>the</strong>se two criteria <strong>on</strong> a<br />

case-by-case basis and <strong>on</strong>ly when an issue requiring<br />

judicial determinati<strong>on</strong> has arisen. 1812 The Chamber<br />

noted <strong>the</strong> Appeals Chamber jurisprudence which<br />

had held that victims do not have a general right to<br />

participate at <strong>the</strong> investigati<strong>on</strong> stage of a Situati<strong>on</strong>,<br />

but acknowledged that victims could be permitted<br />

to participate in judicial proceedings at <strong>the</strong> Situati<strong>on</strong><br />

stage. 1813 Pre-Trial Chamber II <strong>the</strong>refore held that<br />

victim participati<strong>on</strong> at <strong>the</strong> Situati<strong>on</strong> stage can occur<br />

<strong>on</strong>ly when an issue arises which may require judicial<br />

determinati<strong>on</strong>. The Chamber provided a number of<br />

examples of issues requiring judicial determinati<strong>on</strong><br />

which may arise at <strong>the</strong> Situati<strong>on</strong> stage of proceedings,<br />

including but not limited to <strong>the</strong> power of <strong>the</strong> Chamber<br />

to review a decisi<strong>on</strong> by <strong>the</strong> Prosecutor not to proceed<br />

with an investigati<strong>on</strong> or prosecuti<strong>on</strong> under Article 53,<br />

<strong>the</strong> preservati<strong>on</strong> of evidence in <strong>the</strong> c<strong>on</strong>text of a unique<br />

investigative opportunity under Article 56(3), issues<br />

of victims’ protecti<strong>on</strong> or privacy or <strong>the</strong> preservati<strong>on</strong> of<br />

evidence arising under Article 57(3)(c), or <strong>the</strong> power of<br />

<strong>the</strong> Chamber to seek <strong>the</strong> views of victims or <strong>the</strong>ir legal<br />

representatives <strong>on</strong> any issue under Rule 93. 1814<br />

Pre-Trial Chamber II noted that <strong>the</strong> Appeals Chamber<br />

decisi<strong>on</strong> of 19 December 2008 1815 had explicitly left<br />

open <strong>the</strong> questi<strong>on</strong> of how applicati<strong>on</strong>s for victim<br />

participati<strong>on</strong> at <strong>the</strong> Situati<strong>on</strong> stage should be dealt<br />

with in <strong>the</strong> future. The Chamber <strong>the</strong>refore sought<br />

to define <strong>the</strong> procedural framework for victim<br />

participati<strong>on</strong> at <strong>the</strong> Situati<strong>on</strong> stage. The Chamber<br />

identified three hypo<strong>the</strong>ses which would lead a<br />
