All organs of <strong>the</strong> Court should reverse <strong>the</strong> growing trend of opti<strong>on</strong>al compliance with <strong>the</strong> Staff<br />

Rules and Regulati<strong>on</strong>s regarding recruitment processes. There is an increasing practice by <strong>the</strong><br />

leadership within <strong>the</strong> ICC and those whom <strong>the</strong>y direct, to c<strong>on</strong>sider Court policies and regulati<strong>on</strong>s<br />

as guidelines ra<strong>the</strong>r than instructi<strong>on</strong>s which must be c<strong>on</strong>sistently applied. The Committee <strong>on</strong><br />

Budget and Finance (CBF) has noted <strong>on</strong> several occasi<strong>on</strong>s <strong>the</strong> lack of transparency in <strong>the</strong> Court’s<br />

recruitment processes 260 and <strong>the</strong> lack of written administrative instructi<strong>on</strong>s. 261<br />

At <strong>the</strong> seventeenth sessi<strong>on</strong> of <strong>the</strong> CBF, in 2010, <strong>the</strong> Committee noted that <strong>the</strong>re were five<br />

cases pending before <strong>the</strong> Internati<strong>on</strong>al Labour Organisati<strong>on</strong> Administrative Tribunal. It is<br />

unclear whe<strong>the</strong>r <strong>the</strong>se cases relate to a breach of due process and n<strong>on</strong>-compliance by <strong>the</strong><br />

Court in relati<strong>on</strong> to <strong>the</strong> Staff Rules and Regulati<strong>on</strong>s, however such litigati<strong>on</strong> appears to indicate<br />

management and compliance-oversight functi<strong>on</strong>s within <strong>the</strong> Court are not sufficiently effective.<br />

In additi<strong>on</strong>, such cases may c<strong>on</strong>stitute a significant expense for <strong>the</strong> ICC. 262<br />

The Court should implement effective human resource management practices to ensure that<br />

all organs are always in compliance with <strong>the</strong> ICC Rules and Regulati<strong>on</strong>s and begin to establish<br />

best practices in relati<strong>on</strong> to recruitment and o<strong>the</strong>r processes. The Registrar and <strong>the</strong> Prosecutor<br />

must ensure that <strong>the</strong> human resource units under <strong>the</strong>ir management are supported to m<strong>on</strong>itor<br />

deviati<strong>on</strong>s from <strong>the</strong> Rules and establish corrective interventi<strong>on</strong>s should such deviati<strong>on</strong>s be<br />

identified.<br />

The Court must be willing to address imbalances in gender and geographical representati<strong>on</strong><br />

at mid-to-senior level positi<strong>on</strong>s as well as create an instituti<strong>on</strong> supportive of staff learning and<br />

development.<br />

The Heads of Organs and ASP must ensure <strong>the</strong>re is a safe working envir<strong>on</strong>ment for employees,<br />

including an adequate and integrated internal system to deal with grievances, c<strong>on</strong>flicts,<br />

disputes and complaints including, but not limited to, sexual and o<strong>the</strong>r forms of harassment.<br />

Str<strong>on</strong>g disciplinary measures should be taken to address such harassment. A pattern of similar<br />

behaviour by an individual should result in terminati<strong>on</strong> of <strong>the</strong>ir employment c<strong>on</strong>tract or in <strong>the</strong><br />

case of an elected official, removal from office.<br />

Staff should feel safe and be encouraged to report improper or inappropriate behaviour or<br />

acti<strong>on</strong>s which could compromise <strong>the</strong> good standing of <strong>the</strong> Court, including if such behaviour is<br />

dem<strong>on</strong>strated by a Head of Organ or o<strong>the</strong>rs in leadership positi<strong>on</strong>s, without fear of reprisals or<br />

retaliati<strong>on</strong>s.<br />
