Although <strong>the</strong> Chamber, in reclassifying acts of forcible<br />
circumcisi<strong>on</strong> as o<strong>the</strong>r inhumane acts, overlooked<br />
this broader c<strong>on</strong>text of <strong>the</strong> crimes, <strong>the</strong> Office of <strong>the</strong><br />
Prosecutor had also failed to stress <strong>the</strong>se points in its<br />
applicati<strong>on</strong> for summ<strong>on</strong>ses to appear, which merely<br />
stated that <strong>the</strong>se acts were of a sexual nature, without<br />
elaborating <strong>on</strong> this point. The Women’s Initiatives has<br />
called <strong>on</strong> <strong>the</strong> Prosecutor to properly argue <strong>the</strong> case<br />
for charging forced circumcisi<strong>on</strong> as a form of sexual<br />
violence.<br />
Two of <strong>the</strong> three Judges of Pre-Trial Chamber II,<br />
Judge Trendafilova and Judge Kaul, have previously<br />
c<strong>on</strong>tributed to jurisprudence <strong>on</strong> <strong>the</strong> crime of o<strong>the</strong>r<br />
forms of sexual violence, holding in <strong>the</strong> Bemba case<br />
that forced nudity did not c<strong>on</strong>stitute this crime <strong>on</strong> <strong>the</strong><br />
grounds that it was not of comparable gravity to <strong>the</strong><br />
o<strong>the</strong>r crimes enumerated under Article 7(1)(g) of <strong>the</strong><br />
Rome Statute. 899<br />
C<strong>on</strong>firmati<strong>on</strong> of charges hearings<br />
On 3 June 2011, <strong>the</strong> Chamber requested observati<strong>on</strong>s<br />
from all parties and participants in both cases <strong>on</strong><br />
<strong>the</strong> possibility and feasibility of c<strong>on</strong>ducting <strong>the</strong><br />
c<strong>on</strong>firmati<strong>on</strong> of charges hearings in Kenya, ra<strong>the</strong>r than<br />
at <strong>the</strong> seat of <strong>the</strong> Court in The Hague. 900 As described<br />
in greater detail in <strong>the</strong> Protecti<strong>on</strong> secti<strong>on</strong>, in a decisi<strong>on</strong><br />
<strong>on</strong> 29 June 2011 in <strong>the</strong> Ruto et al case, and in a<br />
decisi<strong>on</strong> <strong>on</strong> 19 July 2011 in <strong>the</strong> Muthaura et al case, in<br />
preparati<strong>on</strong> for <strong>the</strong> c<strong>on</strong>firmati<strong>on</strong> hearings, <strong>the</strong> Single<br />
Judge indicated that <strong>the</strong> Chamber would not c<strong>on</strong>sider<br />
fur<strong>the</strong>r <strong>the</strong> opti<strong>on</strong> of holding c<strong>on</strong>firmati<strong>on</strong> hearings in<br />
Kenya because of security c<strong>on</strong>cerns. 901<br />
In preparati<strong>on</strong> for <strong>the</strong> c<strong>on</strong>firmati<strong>on</strong> hearing, <strong>the</strong><br />
document c<strong>on</strong>taining <strong>the</strong> charges in <strong>the</strong> case of Ruto<br />
et al was filed by <strong>the</strong> Prosecuti<strong>on</strong> <strong>on</strong> 1 August 2011, 902<br />
and an amended versi<strong>on</strong>, providing small correcti<strong>on</strong>s,<br />
<strong>on</strong> 15 August 2011. 903 The document c<strong>on</strong>taining <strong>the</strong><br />
charges in <strong>the</strong> case of Muthaura et al was filed <strong>on</strong> 19<br />
August 2011, 904 and an amended versi<strong>on</strong>, providing<br />
small correcti<strong>on</strong>s, <strong>on</strong> 2 September 2011. 905<br />
The c<strong>on</strong>firmati<strong>on</strong> of charges hearing in <strong>the</strong> case of<br />
Ruto et al was held before Pre-Trial Chamber II from<br />
1 September – 8 September 2011. 906 The Chamber<br />
authorised 327 victims – 146 female and 181 male<br />
victims – to participate in <strong>the</strong> proceedings, represented<br />
by Comm<strong>on</strong> Legal Representative Sureta Chana. The<br />
Pre-Trial Chamber had not handed down a decisi<strong>on</strong> <strong>on</strong><br />
<strong>the</strong> c<strong>on</strong>firmati<strong>on</strong> of charges as of <strong>the</strong> writing of this<br />
<str<strong>on</strong>g>Report</str<strong>on</strong>g>.<br />
In its opening statement, <strong>the</strong> Prosecuti<strong>on</strong> argued that<br />
<strong>the</strong> evidence presented by <strong>the</strong> Prosecuti<strong>on</strong> should<br />
lead <strong>the</strong> Pre-Trial Chamber to c<strong>on</strong>firm <strong>the</strong> charges<br />
against Ruto, Kosgey and Sang and to commit <strong>the</strong>m<br />
to trial. The Victims’ Legal Representative explained<br />
that <strong>the</strong> victims ‘have a l<strong>on</strong>ging to see justice d<strong>on</strong>e<br />
in relati<strong>on</strong> to what happened to <strong>the</strong>m and to obtain<br />
reparati<strong>on</strong> for <strong>the</strong>ir losses’. 907 With <strong>the</strong> c<strong>on</strong>tinuing<br />
reign of impunity in Kenya, <strong>the</strong> victims expressed<br />
<strong>the</strong> belief that <strong>the</strong> ICC process finally presented<br />
