Judiciary – Key Decisi<strong>on</strong>s Victim Participati<strong>on</strong><br />
There has been a noted change in <strong>the</strong> relative<br />
percentages of victim participants accepted in<br />
each of <strong>the</strong> Situati<strong>on</strong>s before <strong>the</strong> Court. During<br />
<strong>the</strong> period of time covered by <strong>the</strong> <str<strong>on</strong>g>Gender</str<strong>on</strong>g> <str<strong>on</strong>g>Report</str<strong>on</strong>g><br />
<str<strong>on</strong>g>Card</str<strong>on</strong>g> 2010, <strong>the</strong> DRC Situati<strong>on</strong> and associated<br />
cases accounted for <strong>the</strong> overwhelming<br />
majority (almost 70%) of victims accepted to<br />
participate before <strong>the</strong> Court. 1695 Due to <strong>the</strong><br />
substantial increase in <strong>the</strong> number of victim<br />
participants in <strong>the</strong> CAR Situati<strong>on</strong> in <strong>the</strong> last<br />
year, specifically in <strong>the</strong> Bemba case, <strong>the</strong> DRC<br />
Situati<strong>on</strong> and associated cases now represent<br />
a little over <strong>on</strong>e quarter of <strong>the</strong> total number<br />
of victim participants, 1696 while <strong>the</strong> Bemba<br />
case (and by extensi<strong>on</strong> <strong>the</strong> CAR Situati<strong>on</strong>) now<br />
accounts for just over half of <strong>the</strong> total number of<br />
participating victims before <strong>the</strong> Court. 1697 There<br />
has been no increase in <strong>the</strong> number of victim<br />
participants accepted in <strong>the</strong> Uganda Situati<strong>on</strong><br />
or <strong>the</strong> case against Joseph K<strong>on</strong>y, although <strong>the</strong><br />
total number of participating victims before<br />
<strong>the</strong> Court has risen substantially. As a result,<br />
<strong>the</strong> Uganda Situati<strong>on</strong> now accounts for a little<br />
under 2% of <strong>the</strong> victim participants, down<br />
from 6% last year. 1698 Although <strong>the</strong>re has been<br />
<strong>on</strong>ly a negligible increase in <strong>the</strong> number of<br />
victim participants in <strong>the</strong> Darfur Situati<strong>on</strong> and<br />
associated cases, it represents a significantly<br />
smaller percentage of <strong>the</strong> total number of<br />
participating victims, down from 12% last year to<br />
less than 4% this year. 1699 No victim participants<br />
had been accepted in <strong>the</strong> Kenya Situati<strong>on</strong> or<br />
cases during <strong>the</strong> period covered by <strong>the</strong> <str<strong>on</strong>g>Gender</str<strong>on</strong>g><br />
<str<strong>on</strong>g>Report</str<strong>on</strong>g> <str<strong>on</strong>g>Card</str<strong>on</strong>g> 2010, but it now accounts for over<br />
17% of <strong>the</strong> total number of participating victims,<br />
<strong>the</strong> third highest percentage by Situati<strong>on</strong> behind<br />
<strong>the</strong> DRC and <strong>the</strong> CAR. 1700<br />

to participate (67.86%) related to <strong>the</strong> Situati<strong>on</strong> in <strong>the</strong><br />
DRC and <strong>the</strong> three cases <strong>the</strong>n arising from it. As of 30<br />
September 2009, <strong>the</strong> DRC Situati<strong>on</strong> and cases accounted<br />
for almost 85% of victim participati<strong>on</strong> (644 of 771 victim<br />
participants or 83.5%).<br />
1696 According to figures provided by <strong>the</strong> VPRS, 823 (or<br />
25.86%) of <strong>the</strong> 3,182 victims granted <strong>the</strong> right to<br />
participate are participating in proceedings relating to<br />
<strong>the</strong> DRC situati<strong>on</strong> and cases.<br />
1697 According to figures provided by <strong>the</strong> VPRS, 1,619 of<br />
<strong>the</strong> 3,182 victims granted <strong>the</strong> right to participate are<br />
participating in <strong>the</strong> CAR Situati<strong>on</strong> and cases. Although<br />
no victim participants have been accepted in <strong>the</strong><br />
CAR Situati<strong>on</strong> itself, victim participants in <strong>the</strong> Bemba<br />
case al<strong>on</strong>e account for 50.87% of <strong>the</strong> total number of<br />
participating victims before <strong>the</strong> Court. As of 30 August<br />
2010, <strong>the</strong> CAR Situati<strong>on</strong> and cases amounted to less than<br />
14% of <strong>the</strong> total number of participating victims (135 of<br />
975 in total).<br />
1698 The VPRS email indicates that a total of 62 applicants<br />
have been accepted to participate in <strong>the</strong> Uganda<br />
Situati<strong>on</strong> and <strong>the</strong> K<strong>on</strong>y et al case since 2005. This<br />
amounts to 1.95% of <strong>the</strong> 3,182 accepted victim<br />
participants.<br />
1699 The VPRS email indicates that 116 or 3.71% of <strong>the</strong> 3,182<br />
victim participants relate to <strong>the</strong> Darfur Situati<strong>on</strong> and<br />
<strong>the</strong> three cases associated with it. The 87 victims who<br />
had been granted victim participant status in <strong>the</strong> Abu<br />
Garda case have not been included in <strong>the</strong>se figures.<br />
