Disclosure of identifying<br />

informati<strong>on</strong><br />

The redacti<strong>on</strong> or n<strong>on</strong>-disclosure of identifying<br />

informati<strong>on</strong> has been used extensively by<br />

all Chambers as a measure of protecti<strong>on</strong> for<br />

victims, witnesses, sources, intermediaries and<br />

pers<strong>on</strong>s at risk <strong>on</strong> account of <strong>the</strong> activities of <strong>the</strong><br />

Court. According to <strong>the</strong> Rules of Procedure and<br />

Evidence, redacti<strong>on</strong>s are excepti<strong>on</strong>al measures<br />

that may be undertaken <strong>on</strong>ly when disclosure<br />

of informati<strong>on</strong> could prejudice fur<strong>the</strong>r or<br />

<strong>on</strong>going investigati<strong>on</strong>s or threaten <strong>the</strong> security<br />

of witnesses, victims or <strong>the</strong>ir family members.<br />

A determinati<strong>on</strong> of whe<strong>the</strong>r redacti<strong>on</strong>s are<br />

necessary requires balancing competing<br />

principles: <strong>the</strong> right of <strong>the</strong> accused to a fair trial,<br />

<strong>the</strong> Chamber’s duty to protect <strong>the</strong> safety and<br />

well-being, dignity and privacy of victims and<br />

witnesses, and <strong>the</strong> Prosecuti<strong>on</strong>’s obligati<strong>on</strong> to<br />

disclose exculpatory material to <strong>the</strong> Defence.<br />

Trial Chambers I and II’s use of redacti<strong>on</strong>s to<br />

protect victims and witnesses was described<br />

extensively in <strong>the</strong> <str<strong>on</strong>g>Gender</str<strong>on</strong>g> <str<strong>on</strong>g>Report</str<strong>on</strong>g> <str<strong>on</strong>g>Card</str<strong>on</strong>g> 2009. 2047<br />

Since that time, <strong>the</strong> standards for <strong>the</strong> use of<br />

redacti<strong>on</strong>s had seemed somewhat settled.<br />

However, <strong>the</strong> applicati<strong>on</strong> and lifting of<br />

redacti<strong>on</strong>s in <strong>the</strong> unfolding jurisprudence of <strong>the</strong><br />

Court c<strong>on</strong>tinue to have important implicati<strong>on</strong>s<br />

for protecti<strong>on</strong>.<br />

The Prosecutor v. Thomas Lubanga Dyilo<br />

The disclosure of previously redacted informati<strong>on</strong><br />

As described in <strong>the</strong> Trial Proceedings secti<strong>on</strong> of<br />

this <str<strong>on</strong>g>Report</str<strong>on</strong>g>, <strong>the</strong> abuse of process claim 2048 filed by<br />

<strong>the</strong> Lubanga Defence resulted in Trial Chamber I<br />

issuing a series of decisi<strong>on</strong>s between December<br />

2010 and March 2011 that required <strong>the</strong> Prosecuti<strong>on</strong><br />

to delete redacti<strong>on</strong>s from previously disclosed<br />

evidence. 2049 Although <strong>the</strong> Chamber cauti<strong>on</strong>ed that<br />

this informati<strong>on</strong> should not be disclosed bey<strong>on</strong>d <strong>the</strong><br />

core Defence team, <strong>the</strong> decisi<strong>on</strong> led to <strong>the</strong> names of<br />

victims, witnesses, and <strong>the</strong>ir families being disclosed<br />

to <strong>the</strong> Defence. 2050 Where possible, <strong>the</strong> parties or<br />

<strong>the</strong> VPRS met with victims to determine <strong>the</strong>ir views<br />

<strong>on</strong> <strong>the</strong> disclosure of <strong>the</strong>ir identities. 2051 The OPCV<br />

objected to <strong>the</strong> disclosures because of security<br />

c<strong>on</strong>cerns not <strong>on</strong>ly for <strong>the</strong> victims identified, but also<br />

for those participating an<strong>on</strong>ymously, including victims<br />

participating in <strong>the</strong> Katanga & Ngudjolo proceedings<br />

before Trial Chamber II. 2052 Subsequently, in June 2011,<br />

Trial Chamber I ruled that <strong>the</strong> previously-redacted<br />

names of four victims must be disclosed to <strong>the</strong><br />

Defence as <strong>the</strong>y were necessary for <strong>the</strong> preparati<strong>on</strong> of<br />

its defence, despite <strong>the</strong> fact that <strong>the</strong> VWU had been<br />

unable to locate <strong>the</strong>m to discuss this possibility. 2053<br />

The Prosecutor v. Germain Katanga &<br />

Mathieu Ngudjolo Chui<br />

An<strong>on</strong>ymity maintained for <strong>the</strong> representatives of<br />

deceased victims<br />

In April 2011, Trial Chamber II applied protecti<strong>on</strong><br />

measures to representatives of deceased participating<br />

victims in <strong>the</strong> Katanga & Ngudjolo case. The<br />

Chamber held that <strong>the</strong> protective measures granted<br />

to participating victims also applied to those<br />

participating in <strong>the</strong> name of deceased victims,<br />

including an<strong>on</strong>ymity vis-à-vis <strong>the</strong> public. 2054 At <strong>the</strong><br />

same time, <strong>the</strong> Chamber noted that participating<br />

victims have progressively c<strong>on</strong>sented to disclose <strong>the</strong>ir<br />

identities to <strong>the</strong> parties.<br />

Prior to issuing this decisi<strong>on</strong>, <strong>the</strong> Chamber had<br />

maintained <strong>the</strong> an<strong>on</strong>ymity of <strong>the</strong> deceased victims<br />

vis-à-vis <strong>the</strong> parties until <strong>the</strong>ir relati<strong>on</strong>s had decided<br />

whe<strong>the</strong>r to pursue <strong>the</strong>ir claims. It had also ordered<br />
