witnesses spoke about such widespread acts taking<br />
place. Fundamentally, she emphasised that allegati<strong>on</strong>s<br />
of acts of burning and destructi<strong>on</strong> of property as well<br />
as looting featured prominently and centrally in <strong>the</strong><br />
presentati<strong>on</strong> of <strong>the</strong> Prosecuti<strong>on</strong>’s case. 871<br />
Legal Representative Chana argued that in Article 61(7)<br />
(c)(ii) 872 ‘different’ included <strong>the</strong> sense of ‘additi<strong>on</strong>al’,<br />
and that this allowed <strong>the</strong> Pre-Trial Chamber to request<br />
<strong>the</strong> Prosecutor to amend <strong>the</strong> charge ‘to include<br />
additi<strong>on</strong>al charges or to include additi<strong>on</strong>al criminal<br />
c<strong>on</strong>duct within an existing charge’. 873 She stressed that<br />
<strong>the</strong> victims are c<strong>on</strong>cerned that acts of destructi<strong>on</strong>/<br />
burning of property, looting or inflicti<strong>on</strong> of property<br />
were not necessarily excluded in <strong>the</strong> charges, but<br />
ra<strong>the</strong>r that such acts were not clearly and expressly<br />
included <strong>the</strong>rein. 874 The Legal Representative thus<br />
submitted that <strong>the</strong> Pre-Trial Chamber should exercise<br />
its powers under Article 61(7)(c)(ii) to expressly include<br />
acts of destructi<strong>on</strong> of property and looting in Count 5<br />
and 6 (persecuti<strong>on</strong>), as well as to add counts of o<strong>the</strong>r<br />
inhumane acts of a similar character intenti<strong>on</strong>ally<br />
causing great suffering, or serious injury to body or<br />
mental or physical health (Article 7(1)(k)), regarding<br />
acts of destructi<strong>on</strong> of property, looting and <strong>the</strong><br />
inflicti<strong>on</strong> of pers<strong>on</strong>al injuries to <strong>the</strong> charges against<br />
Ruto, Kosgey and Sang. 875<br />
On 22 September 2011, <strong>the</strong> Pre-Trial Chamber granted<br />
<strong>the</strong> request and directed <strong>the</strong> Legal Representative<br />
to include her observati<strong>on</strong>s in her final written<br />
submissi<strong>on</strong>s. 876 These were filed <strong>on</strong> 30 September<br />
2011. 877 In her final written submissi<strong>on</strong>s, Comm<strong>on</strong><br />
Legal Representative Chana reiterated her previous<br />
arguments, regarding <strong>the</strong> inclusi<strong>on</strong> of acts of<br />
destructi<strong>on</strong> of property, looting and <strong>the</strong> inflicti<strong>on</strong> of<br />
pers<strong>on</strong>al injury within <strong>the</strong> charges and <strong>the</strong> Chamber’s<br />
powers under Article 61(7)(c)(ii). Referring to <strong>the</strong><br />
Appeals Chamber decisi<strong>on</strong> in <strong>the</strong> Lubanga case<br />
c<strong>on</strong>cerning <strong>the</strong> applicability of Regulati<strong>on</strong> 55, she<br />
stressed ‘<strong>the</strong>re is no reas<strong>on</strong> in principle why <strong>the</strong> Pre-<br />
Trial Chamber should have no corresp<strong>on</strong>ding power at<br />
<strong>the</strong> pre-trial stage’. 878<br />

Similarly, in his opening statement at <strong>the</strong> start of <strong>the</strong><br />

2011, Victims’ Comm<strong>on</strong> Legal Representative Morris<br />
Anyah, representing participating victims in <strong>the</strong><br />
sec<strong>on</strong>d case in <strong>the</strong> Kenya Situati<strong>on</strong>, spoke about <strong>the</strong><br />
legal characterisati<strong>on</strong> of <strong>the</strong> facts. He stated that<br />
‘at <strong>the</strong> end of <strong>the</strong>se hearings as you listen to <strong>the</strong><br />
evidence an issue may arise if <strong>the</strong> Prosecuti<strong>on</strong> is<br />
able to sustain its burden and to establish <strong>the</strong> facts<br />
alleged, which include allegati<strong>on</strong>s about destructi<strong>on</strong><br />
of property, whe<strong>the</strong>r or not acts of burning and<br />
destructi<strong>on</strong> of property may be charged as a crime<br />
against humanity of ei<strong>the</strong>r persecuti<strong>on</strong> or forcible<br />
transfer of populati<strong>on</strong>’. 879 He stressed, however, that<br />
this issue would become applicable <strong>on</strong>ly at <strong>the</strong> end of<br />
<strong>the</strong> c<strong>on</strong>firmati<strong>on</strong> hearings. As of <strong>the</strong> time of writing<br />
