The Chamber later designated Marie Edith Douzima<br />
Laws<strong>on</strong> (LRV Douzima Laws<strong>on</strong>) and Assingambi<br />
Zarambaud (LRV Zarambaud), both CAR nati<strong>on</strong>als,<br />
as said representatives. Understandably, <strong>the</strong> victims<br />
were distressed and upset by this decisi<strong>on</strong> as, until<br />
that time, <strong>the</strong>y had relied <strong>on</strong> <strong>the</strong> b<strong>on</strong>d previously<br />
established with representatives of <strong>the</strong> OPCV with<br />
whom a relati<strong>on</strong>ship of trust had been formed. Victims<br />
expressed <strong>the</strong>ir c<strong>on</strong>cern to <strong>the</strong> Women’s Initiatives<br />
that <strong>the</strong>ir interests and <strong>the</strong> particularities of each of<br />
<strong>the</strong>ir experiences may not be well represented given<br />
<strong>the</strong> new legal representatives did not know <strong>the</strong>m, <strong>the</strong>ir<br />
circumstances, <strong>the</strong> crimes committed against <strong>the</strong>m<br />
and <strong>the</strong> impact of <strong>the</strong>se acts. Five victims in <strong>the</strong> Kenya<br />
case have also objected <strong>the</strong> appointment of LRV Chana<br />
as <strong>the</strong>ir legal representative, citing similar c<strong>on</strong>cerns.<br />
Their filing is discussed in detail, below. From <strong>the</strong><br />
public record of <strong>the</strong> case at <strong>the</strong> time of writing this<br />
<str<strong>on</strong>g>Report</str<strong>on</strong>g>, victims in <strong>the</strong> case of Muthaura et al do not<br />
appear to have objected to LRV Anyah’s appointment.<br />
Objecti<strong>on</strong>s to legal representati<strong>on</strong> by<br />
victims in <strong>the</strong> case of Ruto et al<br />
Following <strong>the</strong> 5 August 2011 decisi<strong>on</strong> by Pre-Trial<br />
Chamber II in <strong>the</strong> Ruto et al case <strong>on</strong> comm<strong>on</strong> legal<br />
representati<strong>on</strong> for victims, which appointed Sureta<br />
Chana as <strong>the</strong> Victims’ Comm<strong>on</strong> Legal Representative<br />
for <strong>the</strong> 327 victims accepted to participate, <strong>on</strong> 31<br />
August 2011 four victims (a/0041/10, a/0045/10,<br />
a/0051/10 and a/0056/10) filed a moti<strong>on</strong> with <strong>the</strong> Pre-<br />
Trial Chamber objecting to her appointment as <strong>the</strong>ir<br />
legal representative. 1932 In a separate, c<strong>on</strong>fidential,<br />
filing <strong>on</strong> 5 September 2011, ano<strong>the</strong>r victim (victim<br />
a/0061/11) requested to join <strong>the</strong> previous request. 1933<br />
The victims expressed ‘serious c<strong>on</strong>cern’ about <strong>the</strong><br />
appointment of LRV Chana as <strong>the</strong>ir legal representative<br />
and about <strong>the</strong> procedure followed in respect of this<br />
appointment. 1934 The moti<strong>on</strong> was submitted <strong>on</strong> behalf<br />
of <strong>the</strong> victims by <strong>the</strong> legal representatives with whom<br />
<strong>the</strong>y have worked for almost four years. 1935 In <strong>the</strong>ir<br />
moti<strong>on</strong>, <strong>the</strong> victims indicated that <strong>the</strong>y felt that LRV<br />
Chana had been imposed up<strong>on</strong> <strong>the</strong>m by <strong>the</strong> Chamber,<br />
and stressed that <strong>the</strong> legal representati<strong>on</strong> agreement<br />
of 2008 between <strong>the</strong>m and <strong>the</strong>ir previous legal<br />
representatives had not yet been terminated. 1936 The<br />
victims argued that <strong>the</strong> Registrar’s selecti<strong>on</strong> procedure<br />
c<strong>on</strong>tained ‘serious errors’ and ‘violati<strong>on</strong>s of law’ and<br />
that, as a result, <strong>the</strong>ir rights as victims under <strong>the</strong> Rome<br />
Statute had been violated.<br />
In particular, <strong>the</strong> victims raised a number of errors<br />
in <strong>the</strong> Registrar’s selecti<strong>on</strong> procedure. 1937 First, <strong>the</strong><br />
victims stated <strong>the</strong>y had not been involved in <strong>the</strong><br />
procedure regarding <strong>the</strong> appointment of <strong>the</strong> comm<strong>on</strong><br />
legal representative. Sec<strong>on</strong>d, according to <strong>the</strong> victims,<br />
<strong>the</strong> Registrar did not give any c<strong>on</strong>siderati<strong>on</strong> to <strong>the</strong>ir<br />
views in <strong>the</strong> matter. Third, <strong>the</strong> victims were not<br />
afforded an opportunity to organise <strong>the</strong>mselves to<br />
arrange (comm<strong>on</strong>) legal representati<strong>on</strong> <strong>the</strong>mselves.<br />
The victims also noted that <strong>the</strong>y did not know LRV<br />
Chana and expressed c<strong>on</strong>cern that <strong>the</strong> timing of her<br />
appointment – three weeks prior to <strong>the</strong> c<strong>on</strong>firmati<strong>on</strong><br />
hearing – precluded <strong>the</strong> c<strong>on</strong>structi<strong>on</strong> of a meaningful<br />
relati<strong>on</strong>ship with <strong>the</strong> appointed comm<strong>on</strong> legal<br />
representative. They also raised c<strong>on</strong>cerns about <strong>the</strong><br />
high number of victims represented by <strong>on</strong>e legal<br />
representative (327) which ‘makes a meaningful<br />
