OTP Investigati<strong>on</strong> and Prosecuti<strong>on</strong> Strategy<br />

<str<strong>on</strong>g>Gender</str<strong>on</strong>g>-based violence charged as torture or<br />

outrages <strong>on</strong> pers<strong>on</strong>al dignity has never been<br />

successfully c<strong>on</strong>firmed at <strong>the</strong> ICC.<br />

The reas<strong>on</strong>s for <strong>the</strong> vulnerability of charges for<br />

gender-based crimes have varied from case to<br />

case. In some cases, for example in <strong>the</strong> Lubanga<br />

case, <strong>the</strong> absence of any charges for genderbased<br />

crimes appears to result from <strong>the</strong> failure<br />

<strong>on</strong> <strong>the</strong> part of <strong>the</strong> Prosecuti<strong>on</strong> to prioritise sexual<br />

and gender-based violence in its investigati<strong>on</strong>s<br />

and prosecutorial strategy. 467 In some instances,<br />

<strong>the</strong> Pre-Trial Chamber found that <strong>the</strong> Prosecuti<strong>on</strong><br />

had not provided sufficient evidence of genderbased<br />

crimes to uphold <strong>the</strong> charges sought. In<br />

<strong>the</strong> Katanga & Ngudjolo case, for example, <strong>the</strong><br />

Prosecuti<strong>on</strong> did not provide sufficient evidence<br />

to link <strong>the</strong> defendants with <strong>the</strong> charges of<br />

outrages <strong>on</strong> pers<strong>on</strong>al dignity. 468 In <strong>the</strong> Muthaura<br />

et al case, <strong>the</strong> geographic scope of <strong>the</strong> charges of<br />

gender-based crimes were narrowed due to <strong>the</strong><br />

failure of <strong>the</strong> Prosecuti<strong>on</strong> to provide evidence<br />

of <strong>the</strong>ir commissi<strong>on</strong> in certain locati<strong>on</strong>s, as<br />

well as <strong>the</strong> individual criminal resp<strong>on</strong>sibility<br />

of Muthaura, Kenyatta or Ali for gender-based<br />

crimes committed in o<strong>the</strong>r locati<strong>on</strong>s. 469 Women’s<br />

Initiatives’ research shows in some instances<br />

<strong>the</strong> Office of <strong>the</strong> Prosecutor may rely too heavily<br />

<strong>on</strong> informati<strong>on</strong> from UN reports, NGO reports<br />

or informati<strong>on</strong> provided by governments, press<br />

clippings or newspaper articles, to c<strong>on</strong>struct<br />

charges at <strong>the</strong> applicati<strong>on</strong> for arrest warrant<br />

or summ<strong>on</strong>s to appear and c<strong>on</strong>firmati<strong>on</strong> of<br />

charges stages of proceedings, ra<strong>the</strong>r than a<br />

solid reliance <strong>on</strong> witness testim<strong>on</strong>ies and o<strong>the</strong>r<br />

primary evidence. An initial review c<strong>on</strong>ducted by<br />

<strong>the</strong> Women’s Initiatives of <strong>the</strong> publicly available<br />

arrest warrant applicati<strong>on</strong>s shows a liberal<br />

use of open source material in cases for which<br />

charges have been dismissed. 470<br />

In o<strong>the</strong>r instances, charges of gender-based<br />

crimes were not included due to legal findings<br />

by <strong>the</strong> Pre-Trial Chamber, including legal<br />

findings which adopted interpretati<strong>on</strong>s of <strong>the</strong><br />

Rome Statute and Elements of Crimes which<br />

were in some cases excessively narrow and<br />

in o<strong>the</strong>rs directly c<strong>on</strong>tradictory to existing<br />

internati<strong>on</strong>al criminal jurisprudence <strong>on</strong> genderbased<br />

crimes. 471 For example, in <strong>the</strong> decisi<strong>on</strong><br />

<strong>on</strong> <strong>the</strong> Prosecutor’s applicati<strong>on</strong> for a warrant<br />

of arrest in <strong>the</strong> Bemba case, 472 <strong>the</strong> Pre-Trial<br />

Chamber did not include a charge of o<strong>the</strong>r forms<br />

of sexual violence as a crime against humanity<br />

in <strong>the</strong> arrest warrant, which had been based <strong>on</strong><br />

allegati<strong>on</strong>s that MLC troops had forced women<br />

to undress in public in order to humiliate <strong>the</strong>m.<br />

The Pre-Trial Chamber held that ‘<strong>the</strong> facts<br />

submitted by <strong>the</strong> Prosecutor do not c<strong>on</strong>stitute<br />

o<strong>the</strong>r forms of sexual violence of comparable<br />

gravity to <strong>the</strong> o<strong>the</strong>r forms of sexual violence<br />

set forth in Article 7(1)(g)’. 473 The Chamber did<br />

not cite any legal authority for this propositi<strong>on</strong><br />

bey<strong>on</strong>d a footnote to <strong>the</strong> relevant provisi<strong>on</strong> in<br />

<strong>the</strong> Elements of Crimes and did not provide<br />

fur<strong>the</strong>r legal reas<strong>on</strong>ing for <strong>the</strong>ir decisi<strong>on</strong>.<br />
