Budget for <strong>the</strong> ICC<br />

At its seventeenth Sessi<strong>on</strong> in 2011, <strong>the</strong> Committee <strong>on</strong> Budget and<br />

Finance (CBF) of <strong>the</strong> Assembly of States Parties (ASP) proposed<br />

a budget of €112,181,630 for <strong>the</strong> ICC in 2012. 404 The Court had<br />

proposed a 2012 budget of €117,733,000, representing an increase<br />

of €14,125,100, or 13.6%, over <strong>the</strong> ASP-approved budget for 2011.<br />

The primary cost drivers for this increase are <strong>the</strong> new Situati<strong>on</strong><br />

in Libya (€7,200,000) and <strong>the</strong> increase in <strong>the</strong> cost of legal aid for<br />

defence and victims (€4,900,000), amounting to 85% of <strong>the</strong> total<br />

budget increase. 405 The CBF underlined that <strong>the</strong> potential increases<br />

for 2012 could be higher than those identified by <strong>the</strong> Court and<br />

reach €130 milli<strong>on</strong>. 406 At <strong>the</strong> tenth sessi<strong>on</strong> of <strong>the</strong> ASP in December<br />

2011, <strong>the</strong> ASP will review <strong>the</strong> CBF recommendati<strong>on</strong>s and decide<br />

whe<strong>the</strong>r to adopt <strong>the</strong>m. The ASP also retains <strong>the</strong> power to make<br />

fur<strong>the</strong>r changes bey<strong>on</strong>d <strong>the</strong> CBF recommendati<strong>on</strong>s. This secti<strong>on</strong><br />

reviews selected issues as proposed in <strong>the</strong> Court’s budget and<br />

c<strong>on</strong>sidered by <strong>the</strong> CBF in <strong>the</strong>ir report. Detailed recommendati<strong>on</strong>s<br />

<strong>on</strong> <strong>the</strong> budget are c<strong>on</strong>tained in <strong>the</strong> Recommendati<strong>on</strong>s secti<strong>on</strong> of<br />

this <str<strong>on</strong>g>Report</str<strong>on</strong>g>.<br />

In 2012, <strong>the</strong> Court will have at least seven Situati<strong>on</strong>s under investigati<strong>on</strong>, and at least<br />

two <strong>on</strong>going trials 407 with <strong>the</strong> possibility of at least four fur<strong>the</strong>r trials starting in 2012. 408<br />

The Court’s proposed budget is based <strong>on</strong> <strong>the</strong> assumpti<strong>on</strong> that <strong>the</strong> Prosecutor will<br />

c<strong>on</strong>duct seven active investigati<strong>on</strong>s in six Situati<strong>on</strong>s and will maintain nine residual<br />

investigati<strong>on</strong>s. 409 At least eight o<strong>the</strong>r potential situati<strong>on</strong>s will be m<strong>on</strong>itored. 410 In<br />

additi<strong>on</strong>, <strong>the</strong> Court based its budget requests <strong>on</strong> <strong>the</strong> assumpti<strong>on</strong> that trial hearings<br />
