Judiciary – Key Decisi<strong>on</strong>s Protecti<strong>on</strong> and Protective Measures<br />

Interim release<br />

During 2011, <strong>the</strong> Court issued several decisi<strong>on</strong>s<br />

<strong>on</strong> <strong>the</strong> interim release of <strong>the</strong> accused in <strong>the</strong><br />

Bemba and Mbarushimana cases. 2189 This is an<br />

issue with potentially serious implicati<strong>on</strong>s for<br />

<strong>the</strong> safety and security of witnesses and victims,<br />

particularly where Court proceedings have led to<br />

<strong>the</strong>ir identities being revealed to <strong>the</strong> accused or<br />

<strong>the</strong>ir supporters.<br />

The Pre-Trial Chamber has <strong>the</strong> authority to grant<br />

<strong>the</strong> interim release of an accused under Article<br />

60(3). This provisi<strong>on</strong> requires <strong>the</strong> Chamber<br />

to periodically review <strong>the</strong> detenti<strong>on</strong> of <strong>the</strong><br />

accused and to alter its decisi<strong>on</strong>(s) <strong>on</strong> c<strong>on</strong>tinued<br />

detenti<strong>on</strong> if ’changed circumstances so require’.<br />

However, a pers<strong>on</strong> shall c<strong>on</strong>tinue to be detained<br />

for as l<strong>on</strong>g as <strong>the</strong> Pre-Trial Chamber is satisfied<br />

that <strong>the</strong> c<strong>on</strong>diti<strong>on</strong>s set forth in Article 58(1) are<br />

met. These c<strong>on</strong>diti<strong>on</strong>s include that <strong>the</strong> Chamber<br />

must c<strong>on</strong>tinue to find reas<strong>on</strong>able grounds to<br />

believe that <strong>the</strong> pers<strong>on</strong> has committed a crime<br />

within <strong>the</strong> jurisdicti<strong>on</strong> of <strong>the</strong> Court. Sec<strong>on</strong>d,<br />

<strong>the</strong> Chamber must find that <strong>the</strong> c<strong>on</strong>tinued<br />

detenti<strong>on</strong> of <strong>the</strong> pers<strong>on</strong> appears necessary<br />

to ensure his or her appearance at trial, to<br />

preclude <strong>the</strong> obstructi<strong>on</strong> or endangerment<br />

of <strong>the</strong> investigati<strong>on</strong> or proceedings, and to<br />

prevent <strong>the</strong> accused from committing <strong>the</strong><br />

same or crimes related to those for which he is<br />

accused. Pursuant to Article 60(2), if <strong>on</strong>e of <strong>the</strong>se<br />

c<strong>on</strong>diti<strong>on</strong>s is not met, <strong>the</strong> Chamber must release<br />

<strong>the</strong> pers<strong>on</strong>, with or without c<strong>on</strong>diti<strong>on</strong>s.<br />

The Prosecutor v. Jean-Pierre Bemba Gombo<br />

On 7 July 2010, noting that Bemba’s detenti<strong>on</strong> was<br />

due to be reviewed before 30 July, <strong>the</strong> Trial Chamber<br />

ordered <strong>the</strong> Prosecuti<strong>on</strong>, <strong>the</strong> participating victims and<br />

<strong>the</strong> Defence to submit observati<strong>on</strong>s <strong>on</strong> <strong>the</strong> review of<br />

Bemba’s detenti<strong>on</strong>. These submissi<strong>on</strong>s were filed <strong>on</strong> 15<br />

July 2010 by <strong>the</strong> Prosecuti<strong>on</strong> 2190 and <strong>the</strong> participating<br />

victims 2191 and <strong>on</strong> 22 July 2010 by <strong>the</strong> Defence. 2192<br />

On 28 July 2010 Trial Chamber III rendered a decisi<strong>on</strong><br />

<strong>on</strong> its review of Bemba’s detenti<strong>on</strong>, ordering his<br />

c<strong>on</strong>tinued detenti<strong>on</strong>. 2193 This decisi<strong>on</strong> was appealed<br />

by <strong>the</strong> Defence <strong>on</strong> 29 July 2010. 2194 On 19 November<br />

2010, <strong>the</strong> Appeals Chamber issued its decisi<strong>on</strong> <strong>on</strong> <strong>the</strong><br />

appeal, directing Trial Chamber III to carry out a new<br />

review of Bemba’s detenti<strong>on</strong> and possible interim<br />

release under Article 60(3). 2195 It determined that <strong>the</strong><br />

Chamber did not adequately set forth its reas<strong>on</strong>ing for<br />

rejecting Bemba’s request for interim release, and that<br />

it improperly restricted its c<strong>on</strong>siderati<strong>on</strong>s to <strong>on</strong>ly <strong>the</strong><br />

arguments put forth by Bemba. The Appeals Chamber<br />

reversed Trial Chamber III’s decisi<strong>on</strong> and ordered it to<br />

c<strong>on</strong>duct a new review of Bemba’s detenti<strong>on</strong>.<br />

In again rejecting Bemba’s request for interim<br />

release pursuant to <strong>the</strong> Appeals Chamber order, <strong>on</strong><br />

17 December 2010, Trial Chamber III found that <strong>the</strong>re<br />

had been no change in circumstances that warranted<br />

release. Ra<strong>the</strong>r, it found that <strong>the</strong> <strong>on</strong>ly two changed<br />

circumstances (<strong>the</strong> commencement of trial and <strong>the</strong><br />

affirmati<strong>on</strong> of admissibility) favoured c<strong>on</strong>tinued<br />

detenti<strong>on</strong> and did not mitigate in favour of his<br />

release. 2196 Bemba was released very briefly in January<br />

2011 to attend his stepmo<strong>the</strong>r’s funeral in Belgium,<br />

subject to strict c<strong>on</strong>diti<strong>on</strong>s. 2197<br />

Between 3 May and 10 June 2011, <strong>the</strong> Bemba Defence<br />

c<strong>on</strong>fidentially filed three applicati<strong>on</strong>s for release of<br />

<strong>the</strong> accused: <strong>on</strong>e interim, 2198 <strong>on</strong>e provisi<strong>on</strong>al, 2199 and<br />

<strong>on</strong>e ‘to leave detenti<strong>on</strong>’ to travel to <strong>the</strong> DRC in order to<br />

register for <strong>the</strong> upcoming electi<strong>on</strong>s. 2200 In its decisi<strong>on</strong><br />

of 16 August 2011 rejecting all three applicati<strong>on</strong>s, Trial<br />

Chamber III reviewed, as a threshold issue, whe<strong>the</strong>r<br />
