Situati<strong>on</strong>s under preliminary examinati<strong>on</strong><br />

As of 20 June 2011, <strong>the</strong> Office of <strong>the</strong> Prosecutor is<br />

c<strong>on</strong>ducting preliminary examinati<strong>on</strong>s in Colombia,<br />

Afghanistan, Georgia, Guinea, Palestine, Nigeria,<br />

H<strong>on</strong>duras, and <strong>the</strong> Republic of Korea. During a preliminary<br />

examinati<strong>on</strong>, <strong>the</strong> Office of <strong>the</strong> Prosecutor determines<br />

whe<strong>the</strong>r a situati<strong>on</strong> meets <strong>the</strong> legal criteria established<br />

by <strong>the</strong> Statute to warrant investigati<strong>on</strong> by <strong>the</strong> ICC. 526 The<br />

preliminary examinati<strong>on</strong> takes into account jurisdicti<strong>on</strong>,<br />

admissibility and <strong>the</strong> interests of justice. A preliminary<br />

examinati<strong>on</strong> can be initiated by a decisi<strong>on</strong> of <strong>the</strong><br />

Prosecutor, taking into c<strong>on</strong>siderati<strong>on</strong> informati<strong>on</strong> received<br />

<strong>on</strong> crimes within <strong>the</strong> jurisdicti<strong>on</strong> of <strong>the</strong> Court under Article<br />

15 527 of <strong>the</strong> Rome Statute; a referral from a State Party or <strong>the</strong><br />

UN Security Council (UNSC); or a declarati<strong>on</strong> by a n<strong>on</strong>-State<br />

Party pursuant to Article 12(3) of <strong>the</strong> Statute. 528<br />
