The Kenyan Government has argued that<br />

developments in its domestic law, principally<br />

<strong>the</strong> adopti<strong>on</strong> of a new c<strong>on</strong>stituti<strong>on</strong>, now place<br />

it in a better positi<strong>on</strong> to try <strong>the</strong> ICC cases. On<br />

27 August 2010, President Kibaki signed into<br />

law <strong>the</strong> New C<strong>on</strong>stituti<strong>on</strong> of Kenya, after it was<br />

overwhelmingly approved in a referendum <strong>on</strong><br />

4 August 2010. 812 The cerem<strong>on</strong>y <strong>on</strong> 27 August<br />

marking <strong>the</strong> adopti<strong>on</strong> of <strong>the</strong> New C<strong>on</strong>stituti<strong>on</strong><br />

was attended by President Al’Bashir of Sudan,<br />

against whom <strong>the</strong>re is an outstanding ICC Arrest<br />

Warrant. 813 The New C<strong>on</strong>stituti<strong>on</strong> provides<br />

for significant changes to Kenya’s political<br />

and judicial instituti<strong>on</strong>s and is intended to<br />

enable important reforms to <strong>the</strong> country’s<br />

governmental system. The reforms provided for<br />

under <strong>the</strong> New C<strong>on</strong>stituti<strong>on</strong> include, am<strong>on</strong>gst<br />

o<strong>the</strong>rs, <strong>the</strong> enactment of <strong>the</strong> Supreme Court<br />

Act, <strong>the</strong> appointment of Supreme Court Judges,<br />

<strong>the</strong> appointment of a new Chief Justice, a<br />

Deputy Chief Justice and a Director of Public<br />

Prosecuti<strong>on</strong>s, <strong>the</strong> enactment of <strong>the</strong> Vetting of<br />

Judges and Magistrates Act, <strong>the</strong> Judicial Services<br />

Law and <strong>the</strong> C<strong>on</strong>stituti<strong>on</strong> Implementati<strong>on</strong> Law.<br />

However, according to a June 2011 report by<br />

<strong>the</strong> Kenya Nati<strong>on</strong>al Dialogue and Rec<strong>on</strong>ciliati<strong>on</strong><br />

(KNDR) M<strong>on</strong>itoring Project, in practise ‘<strong>the</strong>re<br />

has been limited progress in some areas such<br />

as reforming <strong>the</strong> police, nati<strong>on</strong>al cohesi<strong>on</strong> and<br />

rec<strong>on</strong>ciliati<strong>on</strong>, and <strong>the</strong> fight against impunity in<br />

general’. 814<br />

ICC investigati<strong>on</strong>s have also met with legal<br />

barriers within <strong>the</strong> Kenyan justice system. The<br />

Office of <strong>the</strong> Prosecutor had indicated that<br />

<strong>the</strong>y intended to questi<strong>on</strong> senior government<br />

officials in Kenya as part of <strong>the</strong>ir investigati<strong>on</strong>s.<br />

However, <strong>the</strong> senior government officials invited<br />

to testify by Prosecuti<strong>on</strong> investigators objected<br />

to being questi<strong>on</strong>ed; as such <strong>the</strong>ir statements<br />

are c<strong>on</strong>sidered involuntary and must be taken<br />

before a judge. The ICC investigati<strong>on</strong>s with<br />

respect to <strong>the</strong>se testim<strong>on</strong>ies were <strong>the</strong>refore<br />

delayed while a process was put in place to<br />

facilitate <strong>the</strong> interviews. On 5 October 2010,<br />

Lady Justice Rawal of <strong>the</strong> Kenyan High Court<br />

was appointed to preside over <strong>the</strong> statementtaking,<br />

Kibaki officially signed into law <strong>the</strong> rules and<br />

regulati<strong>on</strong>s pertaining to taking statements<br />

from state officials. However, in December<br />

2010, following <strong>the</strong> Article 58 applicati<strong>on</strong> by <strong>the</strong><br />

Prosecutor, nine pers<strong>on</strong>s to be questi<strong>on</strong>ed by <strong>the</strong><br />

Office of <strong>the</strong> Prosecutor, allegedly senior security<br />

Pre-Trial Chamber, objecting to being questi<strong>on</strong>ed<br />

and seeking certain assurances from <strong>the</strong> ICC.<br />

The applicants requested <strong>the</strong> Pre-Trial Chamber:<br />

(i) to provide assurances that <strong>the</strong>y will not be<br />

prosecuted <strong>on</strong> <strong>the</strong> basis of <strong>the</strong> informati<strong>on</strong> <strong>the</strong>y<br />

will voluntarily provide during <strong>the</strong> requested<br />

interviews; (ii) to issue a declarati<strong>on</strong> that <strong>the</strong>y<br />

cannot be compelled to testify; (iii) to issue an<br />

order suspending <strong>the</strong> process, pending <strong>the</strong>ir<br />

applicati<strong>on</strong> before <strong>the</strong> Pre-Trial Chamber; (iv)<br />

to issue a request to <strong>the</strong> Kenyan authorities<br />

to suspend <strong>the</strong> evidence-taking pending <strong>the</strong>ir<br />

applicati<strong>on</strong>; and (v) to issue a declarati<strong>on</strong> that<br />
