The 2010 Governance <str<strong>on</strong>g>Report</str<strong>on</strong>g> outlined that<br />

although great progress has been made<br />

throughout <strong>the</strong> years to maximise clarity and<br />

minimise internal divisi<strong>on</strong>s, <strong>the</strong> Court should<br />

pay particular attenti<strong>on</strong> to: (i) implementing an<br />

instituti<strong>on</strong>-wide management c<strong>on</strong>trol system;<br />

(ii) developing a comm<strong>on</strong> understanding of<br />

services; and (iii) providing fur<strong>the</strong>r clarity <strong>on</strong> <strong>the</strong><br />

roles and resp<strong>on</strong>sibilities, and potential overlaps,<br />

in specific areas. 318<br />

On 17 June 2011 <strong>the</strong> CBF issued its report <strong>on</strong><br />

<strong>the</strong> implementati<strong>on</strong> and operati<strong>on</strong> of <strong>the</strong> ICC’s<br />

governance arrangements. 319 This report set out<br />

<strong>the</strong> measures <strong>the</strong> Court has taken to fur<strong>the</strong>r<br />

improve its governance framework pursuant to<br />

<strong>the</strong> 2010 Governance <str<strong>on</strong>g>Report</str<strong>on</strong>g>, including:<br />

The development of a comm<strong>on</strong><br />

understanding of services between <strong>the</strong><br />

Registry and <strong>the</strong> OTP, pursuant to <strong>the</strong><br />

Corporate Governance Statement which set<br />

out <strong>the</strong> foundati<strong>on</strong>al principles; 323 and<br />

The clarificati<strong>on</strong> <strong>on</strong> resp<strong>on</strong>sibilities of<br />

<strong>the</strong> different organs of <strong>the</strong> Court, notably<br />

between <strong>the</strong> OTP and <strong>the</strong> Registry in<br />

regards to <strong>the</strong> protecti<strong>on</strong> of pers<strong>on</strong>s at risk<br />

<strong>on</strong> account of <strong>the</strong>ir interacti<strong>on</strong> with <strong>the</strong><br />

Prosecuti<strong>on</strong>, setting out, am<strong>on</strong>gst o<strong>the</strong>r<br />

things, <strong>the</strong> respective resp<strong>on</strong>sibilities <strong>on</strong><br />

<strong>the</strong> OTP and <strong>the</strong> Registry with regard to <strong>the</strong><br />

different protecti<strong>on</strong> tools. 324<br />

C<strong>on</strong>tinued inter-organ coordinati<strong>on</strong> through<br />

<strong>the</strong> Coordinati<strong>on</strong> Council which meets <strong>on</strong><br />

a m<strong>on</strong>thly basis to fulfil its mandate ‘to<br />

discuss and coordinate <strong>on</strong>, where necessary,<br />

<strong>the</strong> administrative activities of <strong>the</strong> organs of<br />

<strong>the</strong> Court’, 320 <strong>the</strong> adopti<strong>on</strong> of a Coordinati<strong>on</strong><br />

Council Tracker System, and <strong>the</strong> creati<strong>on</strong><br />

of various inter-organ working groups<br />

to facilitate coordinati<strong>on</strong> and mutual<br />

cooperati<strong>on</strong> between <strong>the</strong> different organs; 321<br />

A proper, integrated management c<strong>on</strong>trol<br />

system is currently under c<strong>on</strong>siderati<strong>on</strong><br />

within <strong>the</strong> Registry, which will act as a<br />

reporting mechanism by <strong>the</strong> Registry to <strong>the</strong><br />

Presidency, thus providing <strong>the</strong> Presidency<br />

with <strong>the</strong> informati<strong>on</strong> necessary to maintain<br />

strategic oversight; 322<br />
