Define, with urgency, a definiti<strong>on</strong> of ‘serious misc<strong>on</strong>duct’, expressly including sexual violence,<br />

rape, abuse and harassment.<br />

Make explicit <strong>the</strong> need for a gender-competent IOM in <strong>the</strong> compositi<strong>on</strong> of its staff and<br />

operati<strong>on</strong>al scope.<br />

Ensure that <strong>the</strong> IOM develops procedures to refer cases to jurisdicti<strong>on</strong>s regarding allegati<strong>on</strong>s<br />

of suspected criminal misc<strong>on</strong>duct and to cooperate with nati<strong>on</strong>al authorities to investigate and<br />

prosecute such c<strong>on</strong>duct. Particular attenti<strong>on</strong> should be paid to alleged cases of sexual violence,<br />

given <strong>the</strong> variati<strong>on</strong>s in nati<strong>on</strong>al jurisdicti<strong>on</strong>s regarding <strong>the</strong> definiti<strong>on</strong> of rape and o<strong>the</strong>r forms of<br />

sexual violence, including sexual harassment.<br />

Elaborate an outreach programme for <strong>the</strong> IOM to Court staff so that <strong>the</strong>y are properly informed<br />

of <strong>the</strong> IOM’s role, mandate and proceedings. The need for a c<strong>on</strong>tinuous outreach activity within<br />

<strong>the</strong> Court’s organs has been identified by <strong>the</strong> IOM Temporary Head following her preliminary<br />

meetings with Court pers<strong>on</strong>nel.<br />

Approve rules for <strong>the</strong> IOM that hold accountable (including, if appropriate, by terminati<strong>on</strong><br />

of employment) staff members found to have committed criminal offences or o<strong>the</strong>r serious<br />

misc<strong>on</strong>duct. The Staff Rules and <strong>the</strong> Staff Regulati<strong>on</strong>s should <strong>the</strong>refore ensure that all staff are<br />

provided with training, including training of ICC pers<strong>on</strong>nel <strong>on</strong> <strong>the</strong> Court’s positi<strong>on</strong> <strong>on</strong> sexual<br />

exploitati<strong>on</strong> and abuse, so that <strong>the</strong>re can be no misunderstanding regarding c<strong>on</strong>duct that is<br />

not acceptable and <strong>the</strong> potential c<strong>on</strong>sequences of such misc<strong>on</strong>duct. ‘Serious misc<strong>on</strong>duct’ in<br />

this regard should be defined in applicable rules and regulati<strong>on</strong>s to expressly include, but not<br />

be limited to, sexual violence, rape, abuse and harassment, and should result in automatically<br />

waiving immunity for ICC staff. All staff should be provided with training <strong>on</strong> <strong>the</strong>se rules.<br />

Relying solely <strong>on</strong> nati<strong>on</strong>al laws and authorities may not be sufficient in circumstances where<br />

certain acts are not criminalised in <strong>the</strong> country within which <strong>the</strong>y have occurred, but may be<br />

criminalised by internati<strong>on</strong>al law and laws applicable to a majority of States Parties and where<br />

<strong>the</strong> alleged criminality is c<strong>on</strong>sistent with <strong>the</strong> definiti<strong>on</strong>s in <strong>the</strong> Rome Statute. In such instances,<br />

particularly in relati<strong>on</strong> to rape and o<strong>the</strong>r forms of sexual violence where nati<strong>on</strong>al variati<strong>on</strong>s<br />

exist in <strong>the</strong> definiti<strong>on</strong>s of rape, <strong>the</strong>re should be a procedure for <strong>the</strong> IOM to be able to c<strong>on</strong>duct<br />

an investigati<strong>on</strong>, reach its own determinati<strong>on</strong> and advise <strong>on</strong> <strong>the</strong> appropriate resp<strong>on</strong>se to <strong>the</strong><br />

allegati<strong>on</strong>s.<br />

Request <strong>the</strong> IOM to provide an annual report to <strong>the</strong> ASP, outlining <strong>the</strong> number and types<br />

of allegati<strong>on</strong>s and complaints, <strong>the</strong> source (external, internal) and <strong>the</strong> number of allegati<strong>on</strong>s<br />

relating to each divisi<strong>on</strong> of <strong>the</strong> Court. In this way <strong>the</strong> IOM will be able to track patterns of<br />

misc<strong>on</strong>duct, waste or mismanagement within <strong>the</strong> Court and provide recommendati<strong>on</strong>s to<br />

<strong>the</strong> Court for interventi<strong>on</strong>s to address <strong>the</strong> repetiti<strong>on</strong> of such c<strong>on</strong>duct by particular divisi<strong>on</strong>s or<br />

specific individuals. This ensures a systemic ra<strong>the</strong>r than incident-based approach to preventing<br />

and addressing serious misc<strong>on</strong>duct.<br />

Ensure that <strong>the</strong> IOM Manual of Procedures includes provisi<strong>on</strong>s <strong>on</strong> whistleblower protecti<strong>on</strong> and<br />

protecti<strong>on</strong> from retaliati<strong>on</strong>.<br />
