II. The Executive Council of the Colony shall, save as<br />

hereinafter provided, consist ol such persons not exceeding:<br />

four, holding public offices within the Colony as the^<br />

Governor may by an Instrument or Instruments made<br />

in Our name and under the Pubhc Seal of the Colony<br />

constitute and appoint to be Members thereof. WTienever<br />

any such Member shall die, or resign his seat in the said<br />

Council, or be absent from the Colony, or be laT^-fuUy<br />

suspended from his office, or become from any cause incapable<br />

of, discharging the duties thereof, the Governor<br />

may by any such Instrument as aforesaid nominate any<br />

other person whom he shaU think fit, being within the<br />

Colony, to fill any such vacancy.<br />

III. In addition to the ^lembers appointed under the<br />

preceding clause the Governor may, by an Instrument<br />

made in Our Name and under the Pubhc Seal of the-<br />

Colony, appoint any fit persons residing in the Colony,<br />

not exceedmg three in number at any one time, to be<br />

Members of the said Executive Council, and summon<br />

such Additional Members to the meetings of the said<br />

Executive Council on any occasion on which he shall<br />

think it desirable to obtain their advice.<br />

Provided that meetings of the said Executive Council<br />

shall be held to be duly constituted notwithstanding that<br />

the said Additional Members may not have been summoned<br />

thereto.<br />

If any elected Member of the Legislative Coimcil of<br />

the Colo ay be appointed an Additional Member of the<br />

said Executive Council he shall cease to be such Additional<br />

Member as soon as he ceases to be a Member of the Legislative<br />

Council, and if any person who is not an. elected<br />

Member of the Legislative Council be appointed to be an<br />

Additional Member of the Executive Council he shall<br />

vacate his seat as such Additional Member at the end<br />

of three years from the date of the Instrument by which<br />

he is appointed.<br />

IV. The Governor shall without delay report to Us,<br />

through one of Our Principal Secretaries of State, every<br />

appointment to the Executive Council, and every such<br />

appointment may be disallowed by us through one of<br />

Our Principal Secretaries of State, or may be revoked<br />

by the Governor by an Instrument issued in Our name<br />

and under the Pubhc Seal of the Colony.<br />

V. The Governor shall communicate forthwith to the<br />

Executive Council these Our Instructions, and hkewise<br />

aU such others, from time to time, as he shall find convenient<br />

for Our service to impart to them.<br />

VI. The Executive Council shall not proceed to the<br />

despatch of business unless duly summoned by authority<br />

of'the Governor nor unless two Members at the least<br />

(exclusive of himseK or of the Member presiding) be<br />

present and assisting throughout the whole of the meetings<br />

at which any such business shall be despatched.<br />

VII. The Governor shall attend and preside at the<br />

meetings of the Executive Council, unless when prevented<br />

by some necessary or reasonable cause, and in his absence<br />

the senior Member of the Executive Council, actually<br />

present, shall preside at all such meetings ; the seniority<br />

of the Members of the said Council being regulated according<br />

to the order of their respective appointments as Members<br />

of the said Council, unless the Governor shall in any case<br />

otherwise direct.<br />
