II. The Executive Council of the Colony shall, save as
hereinafter provided, consist ol such persons not exceeding:
four, holding public offices within the Colony as the^
Governor may by an Instrument or Instruments made
in Our name and under the Pubhc Seal of the Colony
constitute and appoint to be Members thereof. WTienever
any such Member shall die, or resign his seat in the said
Council, or be absent from the Colony, or be laT^-fuUy
suspended from his office, or become from any cause incapable
of, discharging the duties thereof, the Governor
may by any such Instrument as aforesaid nominate any
other person whom he shaU think fit, being within the
Colony, to fill any such vacancy.
III. In addition to the ^lembers appointed under the
preceding clause the Governor may, by an Instrument
made in Our Name and under the Pubhc Seal of the-
Colony, appoint any fit persons residing in the Colony,
not exceedmg three in number at any one time, to be
Members of the said Executive Council, and summon
such Additional Members to the meetings of the said
Executive Council on any occasion on which he shall
think it desirable to obtain their advice.
Provided that meetings of the said Executive Council
shall be held to be duly constituted notwithstanding that
the said Additional Members may not have been summoned
thereto.
If any elected Member of the Legislative Coimcil of
the Colo ay be appointed an Additional Member of the
said Executive Council he shall cease to be such Additional
Member as soon as he ceases to be a Member of the Legislative
Council, and if any person who is not an. elected
Member of the Legislative Council be appointed to be an
Additional Member of the Executive Council he shall
vacate his seat as such Additional Member at the end
of three years from the date of the Instrument by which
he is appointed.
IV. The Governor shall without delay report to Us,
through one of Our Principal Secretaries of State, every
appointment to the Executive Council, and every such
appointment may be disallowed by us through one of
Our Principal Secretaries of State, or may be revoked
by the Governor by an Instrument issued in Our name
and under the Pubhc Seal of the Colony.
V. The Governor shall communicate forthwith to the
Executive Council these Our Instructions, and hkewise
aU such others, from time to time, as he shall find convenient
for Our service to impart to them.
VI. The Executive Council shall not proceed to the
despatch of business unless duly summoned by authority
of'the Governor nor unless two Members at the least
(exclusive of himseK or of the Member presiding) be
present and assisting throughout the whole of the meetings
at which any such business shall be despatched.
VII. The Governor shall attend and preside at the
meetings of the Executive Council, unless when prevented
by some necessary or reasonable cause, and in his absence
the senior Member of the Executive Council, actually
present, shall preside at all such meetings ; the seniority
of the Members of the said Council being regulated according
to the order of their respective appointments as Members
of the said Council, unless the Governor shall in any case
otherwise direct.
