the same is not paid at the date when it becomes<br />

payable, so much of the property contained in<br />

«uch mortgages may, upon the application of the<br />

Bank be sold by the Principal Land Registry<br />

Officer to satisfy the debt, on evidence being<br />

-adduced to the satisfaction of such officer, that<br />

(a) the debt for the payment oT which mortgages<br />

have been tendered as security is due and<br />

payable and that the same or some part of it<br />

remains unpaid, and further that the debt lor<br />

wluch the properties have been mortgaged to<br />

the Co-operative Society has become payable ;<br />

(6) notice in writing, calKng upon the mortgagor<br />

and oo-opeialive society to. pay the<br />

amount due has been served upon him or them<br />

by the Bank one calendar month at least prior to<br />

the date wdien the application for the sale of the<br />

property is made.<br />

Evidence of the several matters mentioned in<br />

this clause shall be furnished by affidavit or<br />

affirmation to be sworn or affirmed before the<br />

Registrar of any District Court without payment<br />

of any fee in respect thereof ; and, in regard to the<br />

application aforesaid and the sale and registration<br />

in the name of the purchaser of the property, the<br />

Principal Land Regisrty Officer shall have and<br />

exercise all the powers and pri^nleges conferred<br />

upon him by The Sale of Mortgaged Property<br />

Law, 1890, in the full and like manner as if the<br />

proceedings had been had and taken under that<br />

Law.<br />

4. No fee or charge shall be taken or made by<br />

the Principal Land Registry Officer in respect of<br />

proceedings imder this Proclamation or in respect<br />

of any mortgages given in favour of the Bank save<br />

and except those authorised to be taken upon<br />

•effecting a forced sale of immovable property under<br />

the Rules of Sale for the time being in force in the<br />

execution of a civil judgment, and any fee or charge<br />

so taken shall be repaid out of the proceeds of the<br />

sale of the mortgaged property so far as the same<br />

are sufficient to satisfy the amount to be recovered<br />

and the charges aforesaid.<br />

5. In all proceedings under this Proclamation<br />

and the Land Transfer Amendment Law of 1890,<br />

the Bank may act through its duly constituted<br />

Officers who shall from time to time be notified<br />

to the Principal Land Regi.^try Officers of the<br />

several Districts of the Colony by the Bank,, and<br />

the Bank shall in all respects be liable for any<br />

damage arising out of the act or omission of any<br />

officer so representing it.<br />

6. No Princi[)al Land Registry Officer or other<br />

Officer of the Government shall be liable for any<br />

damage or lo.ss arising out of any action taken in<br />

the discharge of his duty in relation to the xjrovisions<br />

of this Proclamation.<br />

7. The privileges hcruinbefore granted may be<br />

altered, varied or rescinded at any time by Proclamation<br />

to be [jubhshed in the Cyprus Gazette.<br />

8. These Regulations may be cited as the Land<br />

Jtegistry (Agricultuial Bank) Regulations, <strong>1925.</strong><br />

HIS EXCELLENCY <strong>THE</strong> OFYICER ADMINLSTERINO<br />

<strong>THE</strong> GOVERNMENT, with the advice and assist­<br />

ance of the Chief Justice, and in exercise of the<br />

powers vested in him by section 15 of the<br />

Charities Law, 1925, is pleased to make the<br />

following Rules of Court which shall come into<br />

force on the 1st day of August, <strong>1925.</strong><br />

1. These Rules may be cited as the Charities<br />

Law Rules of Court, <strong>1925.</strong><br />

2. In these Rules, unless the context otherwise<br />

requires :—<br />

" The Law " means the Charities Law, 1925,<br />

and any Law amending the same ;<br />

" Court " means the Supreme Court of C3rpru8<br />

in the exercise of its jurisdiction under the Law ;<br />

"Judge" means any Judge of the Court or<br />

any person lawfully authorised to act as such ;<br />

" Registrar " means the Registrar of the Court<br />

or any deputy or assistant registrar thereof;<br />

" Proceedings " includes any cause, suit, action,<br />

summons, petition, matter, motion, or apphcation<br />

before or to the Court at any stage thereof;<br />

" Office copy" means a copy of the file of<br />

proceedings or of any part thereof or of any<br />

judgment or order issued out of the office of the<br />

Registrar and certified under his hand and the<br />

Seal of the Court to be a true copy.<br />

3. These Rules shall apply to all proceedings<br />

before the Supreme Court in the exercise of the<br />

jurisdiction conferred on the said Court by the<br />

Law.<br />

4. The Rules of Court in force in the High<br />

Court of Justice in England in connection with<br />

proceedings under Statutes relating to Charities<br />

and Charitable Trusts and to Trustees shall,<br />

with such modifications as the Court may direct,<br />

be in force in all proceedings under the Law.<br />

5. In any proceedings of a purely interlocutory<br />

character a Judge may act alone and in open<br />

Court or in Chambers at his discretion ; all other<br />

proceedings shall be dealt with by the Court in<br />

open Court or in Chambers, as the Court may<br />

direct. Proceedings may, if the Court or Judge<br />

thinks fit, be adjourned from open Court into<br />

Chambers and from Chambers into open Court.<br />
