BY a Convention, between the United Kingdom,<br />

France, Italy and Japan, signed in Paris on<br />

November 23, 1923, it was agreed, to devote<br />

jointly, to the reparation of the damage, suffered<br />

by their nationals, the sums in gold referred to in<br />

Article 58 of the Treaty of Lausanne, and, by the<br />

same Convention the British Government agreed<br />

to devote, to the same purpose, the 5 per cent.<br />

Turkish Treasury Bills (1911) of the nominal<br />

value of £846,100 which the British Treasury had<br />

purchased from'the holders in 1914, and, by the<br />

same Convention, it was further agreed, that a<br />

Commission should be set up, within one month<br />

of the coming into force of the Treaty of Lausanne, COMMISSION FOR <strong>THE</strong> ASSESSMENT OF DAMAGE<br />

to assess damages suffered by the nationals of the<br />

SUFFERED IN TURKEY.<br />

Contracting Powers, ».e., as follows:—<br />

At a plenary session of this Commission held on<br />

(a) Direct damage in respect of persons or<br />

property (other than that referred to in subsection<br />

2 of Article 6 of the Convention) suffered<br />

on territory which was Ottoman on the 1st<br />

August, 1914, or at sea, between the 1st August,<br />

1914, and 6th August, 1924, as the re.sult of any<br />

act or negligence of the Turldsh Government<br />

including damage resulting from measures of<br />

December 10, 1924, it Avas decided that the follow<br />

ing persons of British nationality, including<br />

persons under British protection whose patent of<br />

protection is of a date prior to August 1st, 1914,<br />

should be deemed to have complied with Article 5<br />

of the Convention between the United Kingdom,<br />

France, Italy and Japan^ signed in Paris on November<br />

23rd, 1923, videlicet :—<br />

requisition, sequestration or confiscation and,<br />

also, direct damage suffered on the same territory<br />

between the dates named as the result of any<br />

acts of war whatever party may have been the<br />

author of such acts ;<br />

1. Those who have already made claims to<br />

and received an ackowledgment from the<br />

Reparation Claims Department of the Board<br />

of Trade, London, but not including those who<br />

have made claims to the Public Trustee and the<br />

(6) Direct damage caused by the fire of Foreign Claims Office.<br />

Smyrna, to the rights and property of the<br />

nationals of the Contracting Powers (but subject<br />

to the terms of para. (6) of sub-section 1 of<br />

Article 6 of the Convention) ; '<br />

2. Those who have already made claims to<br />

the British Foreign Office, India Office, the<br />

Government of India or the Government of<br />

any British Dominion, Colony, Dependency<br />

(c) The damiage referred to in paras, (fe) and<br />

(6) suffered, on territory remaining Turkish, at<br />

or Mandated Territory and have received an<br />

acknowledgment from the authority concerned.<br />

the nationals of the Contracting Powers had a<br />

preponderating interest on the 1st August, 1914,<br />

(but subject to a deduction of the value of<br />

advantages of ah economic character referred to<br />

in sub-section 1 of Article 6 of the Convention).<br />

3. Those who have already made claims to the<br />

French authorities in S5aia and have received an<br />

acknowledgment from such authorities.<br />

4. Those who have already made claims to the<br />

Office des Bieiis et Interets Prives, 146, Avenue<br />

Malakoff, Paris, and have received an ackowledgment<br />

thereof.<br />

By the same Convention the Commission is , Persons who have already made claims to any<br />

precluded from dealing wdth claims in respect of the I of the authorities above mentioned may neverthe­<br />

following categories of damage :—<br />

less make fresh claims, if they desire to do so, or<br />

(a) Indirect damage, including deprivation of may add to, or remodel, or otherwise modify their<br />

the use of property and loss of profits ;<br />

existing claims, and, in that event should signify<br />

(6) Claims relating to amounts payable' by the<br />

Hellenic Government in accordance with the<br />

Convention of the 24th July, 1923 ;<br />

(c) The claims of concessionary companies,<br />

on account of the utilisation by the Turkish<br />

Govehiment, of their property, or of their<br />

services, which are to be settled by the Turkish<br />

Government, as provided in the Protocols and<br />

Declarations forming part of the Turkish Peace<br />

what authority their existing claim was made and<br />

the reference number allotted thereto.<br />

and Consulate in. Paris, the British Embassies,<br />

legations and consulates in central Europe and the<br />

Near |]ast, or frpm H.M. Stationery Office, Adastral<br />

This Commission was duly set up on the 6th<br />

August, 1924, and has established its headquarters<br />

in Paris, where it is now prepared to receive claims<br />

from nationals of the Contracting Powers (including<br />

persons protected by the Contracting Powers in<br />
