HIS EXCELLENCY THE GOVERNOR, with
the advice and assistance of the Chief
Justice, and in exercise of the powers vested
in him by the Cyprus Courts of Justice
Order, 1882, and of every other power
enabling him in this behalf, is pleased to
make the following Eules of Court :—
1. These Eules may be cited as the Village
Judge (Malicious Injury to Property Law)
Eules, 1925.
2. In these Eules " The Law" means
the Malicious Injury to Property Laws
1923 and 1925, and any Law amending
the same.
3. Proceedings under the Law shall be
instituted by a proceeding to be called
a petition.
4. Every petition under the Law shall
be signed by or on behalf of the complainant
(hereinafter called the petitioner) and shall
be entitled in the matter of the petitioner,
and in the matter of the Law, and may be
as in Form A. or Form B.- in the First
Schedule hereto, as the case may require.
5. The day to be fixed by the Village
Judge for hearing of a petition shall not be
less than fifteen days from the date of the
filing of the petition. Notice of the day so
fixed may be as in the Form C, in the First
Schedule hereto.
6. The course of procedure on the hearing
of a petition shall, as far as may be, be the
same as on the hearing of an action before
a Village Judge.
7. The course of procedure in appeals from
a judgment or order Q| the Village Judge
in proceedings under the Law shall, as far
as may be, be the same as in appeals from
a judgment or order of a Village Judge in
an action.
8. Where the appeal is made by the
petitioner, service of the copy of the notice
of appeal shall be effected and the copy
shall be posted in the same way as notice
of the day fixed for the hearing of the
petition before the Village Judge is required
by the Law to be given.
9. Where an appeal is made by any person
other than the petitioner, service of the
notice of appeal shall be effected by serving
a copy thereof on the petitioner.
10. A compensation order under the Law
may be as in Form D. in the First Schedule
hereto with such variations as the circumstances
may require.
11. A copy of any compensation order
together with a list of the tax-paying inhabitants
of the village by whom compensation
has been ordered to be paid shall be
posted by or on behalf of the petitioner at
such place or places within the village as
the Village Judge shall direct. Such posting
shall be effected within five days of the
making of the order unless the ViUage Judge
shall otherwise direct.
The costs of obtaining an order under
section 11 of the Law and of obtaining and
posting copies thereof and of the list of
tax-paying inhabitants shall be added to
the amount of compensation directed to be
paid to the petitioner.
12. Service of any copy of a petition oj*
of any notice of any proceeding in any
Court, by the Law or by these Eules required
to be served upon any Mukhtar or other
person, may be effected either by handing
the document to be served to such Mukhtar
or other person or by leaving the same at
the usual or last known place of abode of
such Mukhtar or other person with any
adult inmate therein.
13. The Mukhtar paying into Court the
amount received by him under the provisions
of section 11 (1) of the Law shall apply to
the Village Judge for a warrant? to the
proper officer of the Treasury to receive
the same, and on his application the Village
Judge shall dehver to him a warrant in the
Form E, in the First Schedule hereto. The
Mukhtar shall hand the warrant to the
proper officer of the Treasury and the officer
shall, upon the same being delivered to him,
receive the amount to be paid into Court
and shall deUver to the Mukhtar a receipt
