EULES, <strong>1925.</strong><br />

HIS EXCELLENCY <strong>THE</strong> GOVERNOR, with<br />

the advice and assistance of the Chief<br />

Justice, and in exercise of the powers vested<br />

in him by the Cyprus Courts of Justice<br />

Order, 1882, and of every other power<br />

enabling him in this behalf, is pleased to<br />

make the following Eules of Court :—<br />

1. These Eules may be cited as the Village<br />

Judge (Malicious Injury to Property Law)<br />

Eules, <strong>1925.</strong><br />

2. In these Eules " The Law" means<br />

the Malicious Injury to Property Laws<br />

1923 and 1925, and any Law amending<br />

the same.<br />

3. Proceedings under the Law shall be<br />

instituted by a proceeding to be called<br />

a petition.<br />

4. Every petition under the Law shall<br />

be signed by or on behalf of the complainant<br />

(hereinafter called the petitioner) and shall<br />

be entitled in the matter of the petitioner,<br />

and in the matter of the Law, and may be<br />

as in Form A. or Form B.- in the First<br />

Schedule hereto, as the case may require.<br />

5. The day to be fixed by the Village<br />

Judge for hearing of a petition shall not be<br />

less than fifteen days from the date of the<br />

filing of the petition. Notice of the day so<br />

fixed may be as in the Form C, in the First<br />

Schedule hereto.<br />

6. The course of procedure on the hearing<br />

of a petition shall, as far as may be, be the<br />

same as on the hearing of an action before<br />

a Village Judge.<br />

7. The course of procedure in appeals from<br />

a judgment or order Q| the Village Judge<br />

in proceedings under the Law shall, as far<br />

as may be, be the same as in appeals from<br />

a judgment or order of a Village Judge in<br />

an action.<br />

8. Where the appeal is made by the<br />

petitioner, service of the copy of the notice<br />

of appeal shall be effected and the copy<br />

shall be posted in the same way as notice<br />

of the day fixed for the hearing of the<br />

petition before the Village Judge is required<br />

by the Law to be given.<br />

9. Where an appeal is made by any person<br />

other than the petitioner, service of the<br />

notice of appeal shall be effected by serving<br />

a copy thereof on the petitioner.<br />

10. A compensation order under the Law<br />

may be as in Form D. in the First Schedule<br />

hereto with such variations as the circumstances<br />

may require.<br />

11. A copy of any compensation order<br />

together with a list of the tax-paying inhabitants<br />

of the village by whom compensation<br />

has been ordered to be paid shall be<br />

posted by or on behalf of the petitioner at<br />

such place or places within the village as<br />

the Village Judge shall direct. Such posting<br />

shall be effected within five days of the<br />

making of the order unless the ViUage Judge<br />

shall otherwise direct.<br />

The costs of obtaining an order under<br />

section 11 of the Law and of obtaining and<br />

posting copies thereof and of the list of<br />

tax-paying inhabitants shall be added to<br />

the amount of compensation directed to be<br />

paid to the petitioner.<br />

12. Service of any copy of a petition oj*<br />

of any notice of any proceeding in any<br />

Court, by the Law or by these Eules required<br />

to be served upon any Mukhtar or other<br />

person, may be effected either by handing<br />

the document to be served to such Mukhtar<br />

or other person or by leaving the same at<br />

the usual or last known place of abode of<br />

such Mukhtar or other person with any<br />

adult inmate therein.<br />

13. The Mukhtar paying into Court the<br />

amount received by him under the provisions<br />

of section 11 (1) of the Law shall apply to<br />

the Village Judge for a warrant? to the<br />

proper officer of the Treasury to receive<br />

the same, and on his application the Village<br />

Judge shall dehver to him a warrant in the<br />

Form E, in the First Schedule hereto. The<br />

Mukhtar shall hand the warrant to the<br />

proper officer of the Treasury and the officer<br />

shall, upon the same being delivered to him,<br />

receive the amount to be paid into Court<br />

and shall deUver to the Mukhtar a receipt<br />
