At one time, colleges <strong>and</strong><br />

universities acted as the parents of<br />

their students, but this ended in the<br />

1960s. The state has the right to act<br />

in loco parentis in child welfare<br />

cases. See Parens Patria.<br />

Intentional The law punishes intentional acts<br />

more severely than negligent acts. A<br />

physician who negligently fails to<br />

obtain an informed consent may be<br />

sued only if an injured patient can<br />

establish that he or she would have<br />

refused the surgery had he or she<br />

been given sufficient information. A<br />

physician who intentionally deceives<br />

a patient about surgery can be sued<br />

for battery even if the surgery is a<br />

success.<br />

Intentional Infliction<br />

A cause of action for intentionally<br />

causing emotional suffering. The<br />

Mental Distress defendant must intend to cause the<br />

suffering, the defendant’s conduct<br />

must be outrageous, <strong>and</strong> the suffering<br />

must be more than just the ordinary<br />

distress of daily living.<br />

Interrogatory Written questions used to investigate<br />

a lawsuit or establish facts for a trial.<br />

These are answered in writing <strong>and</strong><br />

under oath. The most common<br />

interrogatories are those that are used<br />

to establish that a copy of a medical<br />

record is complete <strong>and</strong> that the<br />

original record was properly created<br />
