The developer has bought an industrial plot
and is now proposing to build a residential
building on it. Can this be done without a
formal rezoning process?
The proposed 16 meter building will
transgress the height restriction by two
storeys and will occupy more than 75% of
the plot.
according to the municipal planning
regulations for the area, the height of the
buildings should not be more than two
storeys and should be a maximum of 10
meters
The purpose for this erf is found in the
restrictions of the title deed i.e. it shall be
used only for the erection of a building to be
used for the cleaning, salting, storing of
fresh fish in refrigerated rooms (page 2(b) of
the title deed)
The change of land use for this erf would
mean that fisherman are being chased out
of the harbour.
Every plot in Struisbaai has to abide by
building regulations and title deed
restrictions. The proposed development will
cover the whole plot and totally ignore the
regulation that ordinary home owners or
ratepayers have to abide by.
The proposed development does not take
into consideration the building height
restrictions of the area

A new SDF has been passed in accordance
with the Municipal Systems Act as of
December 2009. The 2009 CAM SDF
promotes development within the urban edge,
of which Erf 848 is located. Please refer to

Erf 848 is private land and the fisherfolk
should be independent of it. The proponent
would however attempt to accommodate them
where he can. The operations within the
harbor are comtrolled by MCM and
Department of Public Works, of which the
proponent has no influence. Please refer to
Annexure O of the FEIR.
The site is currently not- and will not be zoned
as residential. Please refer to Sections 2.6
and 2.7 of the FEIR.
