You also imply that for 2000 years the Xoisan has lived here and at that time it was a heritage but since the holiday makers and local farmers have erected dwellings, it is now a free for all. It can also be argued that cities constructed high rise when they ran out of land. In Struisbaai, 50% of land is undeveloped (4 000 electricity accounts vs. 8 000 plots), thus the two storey building restriction. Just that is an attraction by itself. There is also an undeveloped hotel site. It is illegal to construct the building that will occupy more than 75% of the plot. The proposed development will close the only swimming place left as other swimming areas already destroyed. The public servitude on eastern side of the property must remain, it should not be for Municipality to decide nor for the developer A new SDF has been passed in accordance with the Municipal Systems Act as of December 2009. The 2009 CAM SDF promotes development within the urban edge, of which Erf 848 is located. Regarding the title deed restrictions and the proponent‟s intention to apply for the removal of these restrictions please refer to Section 1.4, 2.6 and 2.7 of the FEIR. Development of this nature needs to be taken through certain procedures and processes which include, but are not limited to EIA regulations and LUPO. Various title deed restrictions exist which were imposed in the public interest given the site's proximity to the harbour. These conditions, it is submitted, were imposed in order to ensure that the beneficial use of the harbour and concomitant public right of access to the harbour and other marine resources were retained. Erf 848 is private property, not public open space. The centre courtyard will however act as a communal area for all visitors to the proposed development. Please refer to Sections 2.6 and 2.7 of the FEIR. The public‟s right of access to the harbour would not be infringed by the proposed development in anyway. It is ultimately M&CM‟s responsibility to ensure that resources required by the fisherfolk are provided as is reasonable, not the adjacent private land owner.
