Shield (113 & 112) Karin I Van Niekerk (87) The "no-go" option which maintains the status quo is the preferred option supported by the vast majority of the local and surrounding town residents as well as many visitors to Struisbaai. This should, in a democratic process be taken into account in accessing the impact of this development. Page 12 of the Executive Summary indicates that the public have until 11 November 2009 to submit written comments on the Draft EIR. However on page 1,it indicated that comments can be submitted until 17 November 2009. We trust that comments submitted after 11 November will qualify for the permitted comment period It is known that buildings such as these proposed are usually spoiling the skyline with other features such as satellite dishes, TV antennae, air conditioning units, store tanks and the like. To be fair to the reader, such features should be shown or a plan in mitigation should be presented. As a member of the registered owners of erf 378 I hereby request to be registered as an Interested and Affected party, contact details are provided on the completed registration sheet. I have recently been forwarded a copy of the DEIR dated 9 October 2009, I cannot be certain that I will not have any other concerns Please acknowledge the receipt of this objection The Public Meetings were held when most I&APs could not attend i.e. out of season The no-go option is considered as a feasible alternative throughout the FEIR. While the EIA process is designed to ensure that impact assessment and public comment is provided to the authorities the decision is vested with them and can be appealed – this is the democratic process. Please refer to Section 2.4 and 7.3 of the FEIR. The date for final submission should read 17 November 2009 and comments were accepted throughout this period. Apologies for this typographical error or any confusion caused. Thank you for this valuable suggestion. A mitigation measure regarding the roofscape has been added. The proposed development is currently in the concept phase; however the environmental authorisation decision would limit the proposed development to a certain height. Therefore, peripherals would need to be within the height limit that has been set by the competent authority. Please refer to Annexure O of the FEIR. You have been registered. Stauch Vorster: Building superimposed as close to reality as possible, no effort was ever made to make the building appear smaller. Might not be 100% accurate due the difficulty of the exercise _camera elevation ,camera angles and target elevation of the real photo can differ from that of the model.but the variations are minimal as certain things in the model need to be in scale with certain things on the photograph. A shelve company shifting responsibility after selling the development cannot be held responsible once dissolved The EIA does not deal with the issues comprehensively and sufficiently; I‟ll address my viewpoints accordingly I have protested before but I never received any response. The DEIR is seriously misleading and biased in many respects. The DEIR does not reflect the extent of the opposition to the impact that the proposed development will have on the harbour. It is not mentioned in the DEIR that over a thousand complaints were submitted against the negative impact this proposal will have on the harbour. See section 3.1.12 and 3.1.13 of the comments and response report. Applicants response: The body corporate would be established to perform this function. The pristine nature of Langezandt Fishermens Village should provide an indication of how the proposed development would be managed. Your opinion is noted however the EAP disagrees. Notification has been sent, using the provided contact details. Disagree ever effort has been made to provide all relevant information an specialist inputs for informed-decision making. Please refer to Section 1.8 of the FEIR. All comments have been included in the EIA reports and summarized in the Comment and Response Reports. We have however revised section 3.4 – 3.8 of the FEIR to ensure that the reader is made aware of the nature and quantity of the comments.
