Youldon (93) Hannes and Erica Pienaar (163) Hannes and Erica Pienaar (163) Grant McKinstry (80) We were willing to take MCM on during the VMS 2008- protest and we are more than willing to do the same to the developer of Struisbaai Harbour if our heritage in not left in tacked. The attitude of this development is wrong. The developers are not seriously taking into consideration the needs of others and the pride which people have in their harbour. They are only trying to make a profit using this icon as a focal point. If the developers would show that they're improving the harbour, then I would support them. Residential development in the harbour is only for the financial benefit of the developer and not in the interest of the surrounding residents for the following reasons Hermanus is a good example of where the traditional harbour was preserved as part of the heritage as well as tourist attraction. The Struisbaai harbour is the last harbour of its kind that remains in the country. It is an unspoilt harbour that is used by the local fisherman, beachgoers and pedestrians who walk along the boardwalk that lines the coastline. To access the existing harbour requires to walk on the public servitude. This servitude belongs to the people of Struisbaai, not to the developer. Once again I am assuming that the developer will move to change this to suit his own pocket. Noted. Please refere to Section 5.2.4 of the FEIR. Concerns raised by I&APs as well as issues identified during the EIA by the EAP have been assessed to determine the potential impact that would be caused by the proposed development. Annexures P & R of the FEIR address the issues of Feasibility. Noted. Please refer to Sections 5.2.5, 5.2.6 and 5.2.9 of the FEIR. Please refer to Section 5.2.3 of the FEIR regarding financial benefit. Your point is noted, however accordingy to the Heritage Specialist and the Record of Decision issued by Heritage Western Cape the Struisbaai Harbour contains limited regional heritage value. Please refer to Section 5.2.4 of the FEIR. The servitude is registered in the title deeds and would need to be removed via a planning process i.e. amended to the new high water mark. Refer to Annexure M of the FEIR. Applicants response: Only a fraction of the servitude has been used for many years as the property is enclosed. It is a commercial (small but of significant importance to the local population) fishing harbour which is at the heart and supports the local community, and happens also to be used for recreational purposes due to its rustic atmosphere. The developer's restaurant is incidental - the safe swimming cove and breakwater are much bigger attractions. We (JJJ van Rensburg Familie Trust) are the registered owners of Erf 440 (19 Kusweg-Noord, the house is named Suiderkruis and located across the harbour parking area). Presently the site is home to three single storey buildings (in line with the present Cape Agulhas Spatial Development Framework, 2006 ("SDF"), including Pelicans Restaurant and a fish processing plant known as Harbour Catch which processes approximately 50% of all fish landed in the harbour and also provides ice and bait to the local fishermen [p. 38-39 of dEIR]. It is directly neighbouring and supports the harbour. These services form an integral part of the Struisbaai harbour and contribute towards the livelihood of the persons providing these services, and also the people to whom the services are provided or the goods sold. Not to maintain these services within the proposed development contradicts the very terms of the IDP and SDF, which encourage job creation, to which the development proponent refers and by which the decisionmaker must be guided. Erf 848 is private property. Harbour activities is the responsibility of MCM, though the proponent is willing to incorporate current activities where feasible. The breakwater and swimming cove will remain as is as they form part of the harbor and as a consequence are managed by MCM. Noted. Noted. The CAMSDF has since been replaced with the CAMSDF (2009) which allows builing within the urban edge. Elements of Harbour Catch and Pelican‟s form part of the proposed development (Alternative 6). Please refer to Section 5.2.3 and Annexure H: Economic Assessment of the FEIR regarding job creation.
