Du Plessis (140) The public participation process was not adequate and appropriate opportunity for public participation was not provided as it has been stated on NEMA. Meetings were held when the vast majority of property owners and holiday makers could not attend the meetings. These meetings should be rescheduled to coincide with the peak holiday season i.e. December, the proposed date for such meeting is 30 December 2009. More than 75% of Struisbaai‟s tax payers do not live there on a permanent basis. Hosting an “Open House” on 30 and 31 October 2009 cannot be seen as public participation, in fact it is the exact opposite. According to the Land Use Ordinance No 15 of 1985, the Province has a policy against placing notices over the December holiday. Taking this into account, your aim should be to have the Open House when people would be here, in other words, during the December holiday. Furthermore, the dates that were chosen for the Open House/ Public meeting were not practical for most homeowners. It would have been better to have dates during the holiday season in order to have more people involved. Information meetings are held at obscure times when 80% of the holiday makers and people affected by the development are not in the area. If the developer wants the general public to participate in the process, why were the public meetings conducted outside the holiday season, all owners of stands who are not living in Struisbaai contribute to the rates and taxes of Struisbaai. Applicants response: Struisbaai Ratepayers meeting, which called for attendance in order to discuss the harbor drew a response of 50/60 people in December 2009. One can conclude that hosting the public meetings in October is an attempt to marginalise the bulk of ratepayers who have been the main contributors to the income base of the council. All property owners and residents in Struisbaai and L'Agulhas area must have the right to express their opinion on this matter, this country for too long has been dogged by decisions that suite a few and marginalise the majority. The Public Meetings were held out of season thus denying many seasonal visitors that are property owners an opportunity to comment or make submissions Public meetings should be in December so that more property owners or tourists can be present. Besides the fact that we didn‟t receive any notification of the meeting that was held on 31 October, we wouldn‟t have been able to attend due to the very inconvenient time it was scheduled for. It would make more sense to have meetings when most interested homeowners would be available, i.e. during December / January.
