(g) may, as a condition <strong>of</strong> site plan approval,<br />

require,<br />

(i) an owner <strong>of</strong> land to enter into one or<br />

more agreements with the <strong>City</strong> for<br />

the provision <strong>of</strong> road widenings,<br />

and/or the provision and<br />

maintenance <strong>of</strong> certain site-related<br />

facilities and services associated with<br />

the development;<br />

(ii) the agreement to be financially<br />

secured; and<br />

(iii) an owner <strong>of</strong> land to enter into one or<br />

more agreements with the Regional<br />

Municipality <strong>of</strong> Durham respecting<br />

the provision <strong>of</strong> road widenings or<br />

servicing.<br />

<strong>Plan</strong>s <strong>of</strong> Condominium<br />

15.24 <strong>City</strong> Council,<br />

(a) through participation in the<br />

condominium approval process provided<br />

for in the <strong>Plan</strong>ning Act,<br />

(i) shall ensure developments subject to<br />

an application for condominium<br />

tenure comply with the approved site<br />

plan for that site; and<br />

(ii) may require the owner to enter into<br />

one or more agreements with the <strong>City</strong><br />

respecting site development; and<br />

(b) in evaluating applications for conversion <strong>of</strong><br />

existing rental accommodation to<br />

condominium tenure with respect to the<br />

Rental Housing Protection Act,<br />

(i) shall consider the goals, objectives<br />

and policies <strong>of</strong> this <strong>Plan</strong>, the Durham<br />

Regional <strong>Official</strong> <strong>Plan</strong>, and applicable<br />

provincial policies, having particular<br />

regard for the impact <strong>of</strong> the<br />

conversion on the <strong>City</strong>’s ability to<br />

provide affordable housing; and<br />

(ii) may, as a condition <strong>of</strong> condominium<br />

conversion, require the owner <strong>of</strong> land<br />

to enter into one or more agreements<br />

with the <strong>City</strong> respecting the buildings,<br />

site development or other required<br />

matters.<br />
