15.25 <strong>City</strong> Council shall encourage its Committee<br />

<strong>of</strong> Adjustment to apply the goals, objectives<br />

and policies <strong>of</strong> this <strong>Plan</strong>, and maintain the<br />

purpose and intent <strong>of</strong> the <strong>City</strong>’s zoning<br />

by-laws in making decisions regarding the<br />

granting <strong>of</strong> minor variances pursuant to the<br />

<strong>Plan</strong>ning Act.<br />

15.26 <strong>City</strong> Council, in commenting to the<br />

Regional Land Division Committee<br />

regarding the consideration <strong>of</strong> land<br />

severances pursuant to the <strong>Plan</strong>ning Act,<br />

CITY POLICY<br />

Land Severance<br />

(a) shall be guided by the policies <strong>of</strong> the<br />

Oak Ridges Moraine Conservation <strong>Plan</strong>,<br />

Durham Regional <strong>Official</strong> <strong>Plan</strong>, this<br />

<strong>Plan</strong>, and the regulations and<br />

requirements <strong>of</strong> the <strong>City</strong>’s zoning bylaws;<br />

(b) shall limit the creation <strong>of</strong> lots for<br />

residential purposes by land severance<br />

to a maximum <strong>of</strong> three, and require that<br />

an ownership <strong>of</strong> land capable <strong>of</strong> being<br />

divided into more than three additional<br />

lots be developed by a plan <strong>of</strong><br />

subdivision, except where it is<br />

demonstrated to Council’s satisfaction<br />

that a plan <strong>of</strong> subdivision is neither<br />

appropriate nor necessary in which case<br />

Council may authorize the development<br />

to proceed by land severance;<br />

(c) may, when authorizing a development<br />

to proceed by land division, require the<br />

owner to enter into one or more<br />

agreements respecting matters that<br />

would normally have been covered by a<br />

subdivision agreement, and<br />

(d) for lands within the Oak Ridges<br />

Moraine, shall also require the<br />

following,<br />

(i) permit residential infilling and lot<br />

creation within the hamlet<br />

boundaries <strong>of</strong> Claremont as<br />

expansions to the hamlet boundary<br />

shall not be permitted;<br />
