15.31 In accordance with section 10.20(b), <strong>City</strong><br />

Council, in its review <strong>of</strong> development<br />

proposed on lands designated Flood Plain<br />

Special Policy Area, as shown on<br />

Schedule III, shall,<br />

CITY POLICY<br />

Flood Plain Special Policy Areas<br />

(a) permit limited development including<br />

extensions to and rehabilitation <strong>of</strong><br />

buildings and structures on condition that<br />

the proposed development is flood<br />

protected to the level <strong>of</strong> the Regulatory<br />

Flood, as defined by regulations made<br />

under the Conservation Authorities Act,<br />

and to the satisfaction <strong>of</strong> the Toronto and<br />

Region Conservation Authority and the<br />

<strong>City</strong>;<br />

(b) despite the provisions <strong>of</strong> section 15.31(a),<br />

permit a lower level <strong>of</strong> flood protection,<br />

subject to review, where it is technically<br />

not feasible, or it is impractical to flood<br />

protect a building or structure, or an<br />

addition thereto, to the level <strong>of</strong> the<br />

Regulatory Flood;<br />

(c) despite the provisions <strong>of</strong> sections 15.31(a)<br />

and (b), prohibit development on any<br />

parcel <strong>of</strong> land that is wholly or partly<br />

designated Flood Plain Special Policy<br />

Area if,<br />

(i) the development would be subjected<br />

to a water velocity or depth that would<br />

create an unacceptable hazard to life;<br />

or<br />

(ii) the development would be susceptible to<br />

major structural damage as a result <strong>of</strong><br />

a flood less than or equal to the<br />

Regulatory Flood;<br />

(iii) the necessary flood protection<br />

measures would have a negative<br />

impact on adjacent properties;<br />

(iv) the development would be susceptible<br />

to major structural damage from<br />

erosion; or<br />

(v) the development would result in<br />

unacceptable environmental impacts;<br />

(d) prohibit development within an area that<br />

is subject to a risk <strong>of</strong> flooding in excess <strong>of</strong><br />

25% over an assumed life <strong>of</strong> 100 years (a<br />

probability <strong>of</strong> occurrence once in every<br />

350 years) when that development cannot<br />

be flood protected to the level <strong>of</strong> the 1:350<br />

year flood;<br />
