(ii) permit lot creation only if there is<br />

enough net developable area on both<br />

the severed lot and retained lot to<br />

accommodate the proposed buildings,<br />

structure and accessory uses without<br />

encroachment into key natural<br />

heritage features or hydrologically<br />

sensitive features and the related<br />

minimum vegetation protection zone<br />

as shown on Schedule V or as<br />

identified by an approved<br />

environmental report;<br />

(iii) require the applicant to enter into a<br />

site plan agreement or other agreement<br />

to establish conditions requiring that<br />

self sustaining vegetation be<br />

maintained or restored in order to<br />

ensure the long term protection <strong>of</strong> any<br />

key natural heritage features or<br />

hydrologically sensitive features on the<br />

lots;<br />

(iv) prohibit new lot creation within any<br />

part <strong>of</strong> a minimum vegetation<br />

protection zone <strong>of</strong> a key natural<br />

heritage feature and/or hydrologically<br />

sensitive feature;<br />

(v) new estate residential subdivisions shall<br />

not be permitted within the Oak Ridges<br />

Moraine, and<br />

(vi) a lot shall not be created if this would<br />

extend or promote strip development;<br />

(e) for lands within the Oak Ridges Moraine<br />

Natural Core Areas, Natural Linkage Areas,<br />

and Countryside Areas, lot creation may be<br />

permitted under the following conditions,<br />

where applicable:<br />

(i) a maximum cumulative total <strong>of</strong> one<br />

severance, from a rural lot, <strong>of</strong> a farm<br />

retirement lot or a lot for a residence<br />

surplus to a farming operation shall be<br />

permitted for each rural lot;<br />

(ii) all consents granted on or after<br />

January 1, 1994 are included in the<br />

calculation <strong>of</strong> the cumulative total, and<br />

this policy applies whether the<br />

transaction takes the form <strong>of</strong> a<br />

conveyance, a lease for twenty-one<br />

years or more, or a mortgage;<br />

(iii) severances from each other <strong>of</strong> two or<br />

more rural lots that have merged in title<br />

shall follow the original lot lines or<br />

original half lot lines;<br />
