15.34 Despite sections 10.8 and 15.33, <strong>City</strong> Council<br />

shall permit wayside pits, quarries and portable<br />

asphalt plants for a temporary period for use by<br />

the <strong>City</strong>, Regional and Provincial governments<br />

in accordance with the Aggregate Resources<br />

Act without requiring either an amendment to<br />

this <strong>Plan</strong> or an amendment to the zoning<br />

by-law except as follows,<br />

CITY POLICY<br />

Wayside Pits and Quarries<br />

(a) an amendment to the <strong>Plan</strong> and zoning bylaw<br />

shall be required for wayside pits and<br />

quarries in proximity to a wetland, Area <strong>of</strong><br />

Natural and Scientific Interest or<br />

Environmentally Significant Area as<br />

designated on Schedule III, or candidate<br />

Environmentally Significant Area or Area<br />

<strong>of</strong> Natural and Scientific Interest as may be<br />

identified; and<br />

(b) a zoning by-law amendment shall be<br />

required to permit a wayside pit and quarry<br />

in the urban area and within any Rural<br />

Settlement, as identified by this <strong>Plan</strong>.<br />

15.35 Should an aggregate extraction site, or wayside<br />

pit or quarry be established in accordance with<br />

sections 15.33 or 15.34, <strong>City</strong> Council shall<br />

support the rehabilitation requirements <strong>of</strong> the<br />

Ministry <strong>of</strong> Agriculture, Food and Rural Affairs<br />

as follows,<br />

Extraction Sites<br />

(a) by requiring, in those instances where<br />

extraction <strong>of</strong> mineral aggregates has taken<br />

place on Class I, II or III agricultural soils<br />

that are designated Agricultural Areas on<br />

Schedule I, rehabilitation <strong>of</strong> the site to be<br />

carried out whereby substantially the same<br />

areas and same average soil quality for<br />

agriculture are restored; and<br />

(b) despite (a) above, not requiring complete<br />

agricultural rehabilitation if,<br />

(i) there is a substantial quantity <strong>of</strong> mineral<br />

aggregates below the water table<br />

warranting extraction; or,<br />

(ii) the depth <strong>of</strong> planned extracting in a<br />

quarry makes restoration <strong>of</strong> preextraction<br />

agricultural capability<br />

unfeasible; and<br />

(iii) other alternatives have been considered<br />

by the applicant and found unfeasible;<br />

and<br />

(iv) agricultural rehabilitation in remaining<br />

areas will be maximized.<br />
