Public exposure- State and federal laws govern the separation distance betweenpeople, equipment and some utilities especially electrical transmission lines.Recreational use cannot create additional risk of damage to utility structures ortransmission facilities. Activities cannot preclude future construction or expansion ofthe utilities within the right-of-way. Access to/from, and along the right-of-way formaintenance, emergency repairs or future expansion cannot be impeded by recreationaluse. Recreational use must include a management plan that addresses trash collectionand prevention/repair of erosion. Additional impacts to sensitive environmentalresources will be viewed as a negative.Preliminary Design Concepts – NACost Estimate – variableRecommendations for Implementation – Use of utility corridors can requirecomplex legal agreements. Additionally, in some instances the utility has an easementbut does not own the right of way, requiring the involvement of multiple parties toinclude the actual land owner. Conservation easements should also be investigated todetermine if these can be used to encourage dedication of right of way in the existingutility corridors, whether from the utility company or a third part landowner. Pavedtrails may enhance maintenance access in some corridors, thereby yielding a positivebenefit to the utility company.
