3.03 WARRANTY REQUIREMENTS<br />

A. Each warranty period is for 6 yr. and starts the day after written acceptance.<br />

B. The marking warrantor is responsible for meeting the Performance Requirements for the<br />

duration <strong>of</strong> the warranty period.<br />

C. During the warranty period, the <strong>City</strong> will conduct periodic visual performance evaluations <strong>of</strong><br />

the pavement markings. For retroreflectivity the <strong>City</strong> will use Tex-828-B, “Determining<br />

Functional Characteristics <strong>of</strong> Pavement Markings.” The warrantor may be present during these<br />

evaluations. For areas, which, in the opinion <strong>of</strong> the <strong>City</strong> have a questionable visual evaluation,<br />

the warrantor may replace the pavement markings or may conduct a performance evaluation for<br />

the performance requirement in question, conduct retroreflectivity evaluations using either<br />

portable or mobile retroreflectometer unless otherwise indicated in the Contract Documents.<br />

The warrantor is responsible for traffic control when conducting performance evaluations.<br />

D. The warrantor will replace pavement markings that fail to meet the color, retroreflectivity, or<br />

durability performance requirements during the warranty period, and must replace the pavement<br />

markings that fail to meet the performance requirements within 30 days <strong>of</strong> notification.<br />

E. All replacement pavement markings must meet the materials and performance requirements <strong>of</strong><br />

this specification.<br />

F. The end <strong>of</strong> the warranty period does not relieve the warrantor from the performance deficiencies<br />

requiring corrective action identified during the warranty period.<br />

G. The <strong>City</strong> may exclude pavement markings from the replacement provisions <strong>of</strong> the warranty<br />

period, provided the <strong>City</strong> determines that the failure is a result <strong>of</strong> outside causes rather than<br />

defective material. Examples <strong>of</strong> outside causes are extreme wear at intersections, damage by<br />

snow or ice removal, and premature pavement failure.<br />

H. Provide a contact person, address and telephone number for notification <strong>of</strong> needed pavement<br />

markings replacement.<br />

I. Each class <strong>of</strong> raised pavement marker shall be from the same manufacturer.<br />

J. The pavement markers shall be placed in proper alignment with the guides. The deviation rate<br />

in alignment shall not exceed one (1) inch per 200 feet <strong>of</strong> roadway. The maximum deviation<br />

shall not exceed two (2) inches nor shall any deviation be abrupt.<br />

K. Unless otherwise noted, adhesives shall be applied in accordance with the manufacturer’s<br />

recommendations.<br />

L. The roadway to be marked will remain open to traffic and the Contractor shall provide all<br />

necessary warning and barricading to insure the safety <strong>of</strong> the workmen and traffic, and the<br />

Contractor must insure proper maintenance <strong>of</strong> all warning and barricading devices at all times.<br />

Construction, signing, channelizing devices, and markings shall conform to the current Texas<br />

Manual on Uniform Traffic Control Devices (TMUTCD) at all times.<br />

M. A minimum <strong>of</strong> one lane in each direction shall remain open to through traffic at all times.<br />

N. The Contractor shall conduct the installation so as to minimize the duration <strong>of</strong> restricted traffic<br />

movements.<br />

O. The Contractor shall apply pavement markers and markings during <strong>of</strong>f-peak traffic hours (9:00<br />

am – 3:30 pm) or as directed by the <strong>City</strong>.<br />
