<strong>Engineering</strong> <strong>Standards</strong><br />

Definitions<br />

The definitions within this Section are intended to provide descriptions for words and terms used within<br />

the <strong>Engineering</strong> <strong>Standards</strong>. When words and terms are defined herein, and are also defined in other<br />

ordinance(s) <strong>of</strong> the <strong>City</strong>, they shall be read in harmony unless there exists an irreconcilable conflict, in<br />

which case the definition contained in this Section shall control for the <strong>Engineering</strong> <strong>Standards</strong>. Where no<br />

definition appears, then the term should be interpreted according to their customary usage in the practice<br />

<strong>of</strong> municipal planning and engineering. The <strong>City</strong> has the final determination <strong>of</strong> interpretation.<br />

Words used in the present tense include the future; words in the singular number include the plural<br />

number, and words used in the plural number include the singular number. The word shall is mandatory<br />

and not directory. The word may is directory and not mandatory.<br />

Approved, Accepted, Directed, Required, and Words <strong>of</strong> Like Import: Whenever they apply to the<br />

work or its performance, the words "directed," “accepted,” "required," "permitted," "ordered,"<br />

"designated," "established," "prescribed" and words <strong>of</strong> like shall imply the direction, requirement,<br />

permission, order, designation or prescription <strong>of</strong> the <strong>City</strong>; and "approved," "acceptable," "satisfactory"<br />

and words <strong>of</strong> like import shall mean approved by, acceptable to or satisfactory to the <strong>City</strong>.<br />

Backfill: The term means the following (1) the placement <strong>of</strong> new dirt, fill, or other material to refill an<br />

Excavation; or (2) the return <strong>of</strong> excavated dirt, fill or other material to an Excavation.<br />

<strong>City</strong>: The term <strong>City</strong> means the <strong>City</strong> <strong>of</strong> <strong>Frisco</strong> or its authorized representative(s).<br />

Compaction: The term refers to consolidating material to prevent future settlement<br />

Contract or Contract Documents: Contract documents are all <strong>of</strong> the written, printed, typed, drawn<br />

instruments, plans, and specifications that comprise and govern the performance <strong>of</strong> the contract between<br />

the Owner and the Contractor.<br />

Contractor: The person, persons, partnership, firm, corporation, association or organization, or any<br />

combination there<strong>of</strong>, as an independent contractor entering into the contract for the execution <strong>of</strong> the work,<br />

acting directly or through a duly authorized representative. Contractor does not refer to the <strong>City</strong>.<br />

Development: Refers to the project being designed or constructed. (see also Subdivision Ordinance)<br />

Director <strong>of</strong> <strong>Engineering</strong> Services: The Director <strong>of</strong> <strong>Engineering</strong> Services or their authorized<br />

representative. (see also Subdivision Ordinance)<br />

Easement: A property right giving an entity other than the owner permission to use a property for a<br />

specific purpose stated in the easement document. (see also Subdivision Ordinance)<br />

Emergency Operations: Those operations and repairs necessary to prevent damage or injury and to<br />

protect the health or safety <strong>of</strong> the public or any person and the work necessary to address or prevent an<br />

immediate service interruption. Upgrading <strong>of</strong> facilities, new service installation and neighborhood<br />

improvement projects are not emergency operations.<br />

Engineer, Owner’s Engineer, Design Engineer: The Engineer or its duly authorized representative<br />

means the Engineer <strong>of</strong> the Owner, who is the Engineer <strong>of</strong> Record <strong>of</strong> the Contract Documents.<br />
