Notification of said changes shall be made in accordance with<br />

the “GENERAL RULES AND REGULATIONS, Special notice.”<br />

B2. Television and Media <strong>Rule</strong><br />

A. Attendance at a PtHA-approved event, in whatever capacity,<br />

shall constitute authorization for PtHA, its agents, designees,<br />

or assigns to photograph, video tape, televise, or record<br />

by other means (hereinafter referred to as “photographic<br />

material”) any person or <strong>Pinto</strong> on the premises of a PtHAapproved<br />

event, and shall further constitute authorization for<br />

the use of such person’s name, voice and biography, or the<br />

name, pedigree and performance record of any <strong>Pinto</strong> on the<br />

premises (hereinafter referred to as “related information”) in<br />

conjunction with any photographic material.<br />

B. The photographic material and related information referred<br />

to above may be used in any manner that the PtHA, at its<br />

sole discretion, determines would be beneficial to promoting<br />

purposes and goals of the PtHA; provided, however, that no<br />

photographic material or related information will be used in<br />

conjunction with the endorsement of any product unless prior<br />

written consent from PtHA is obtained.<br />

C. Attendance at a PtHA-approved event shall further constitute<br />

agreement to the terms and conditions outlined above, and<br />

shall constitute a waiver and release, without limitation, of any<br />

individual television, radio, motion picture, photographic or<br />

other similar rights, including right of privacy, any person or<br />

<strong>Pinto</strong> may have in or to such photographic material or related<br />

information when such information is obtained at a PtHAapproved<br />

event by the PtHA, its agents, designees, or assigns.<br />

D. PtHA declines advertisement from any equine/equine related<br />

registry or association that is not on the approved PtHA<br />

outcross list.<br />

B3. Responsibility of PtHa<br />

A. The <strong>Pinto</strong> <strong>Horse</strong> <strong>Association</strong> will not assume the responsibility<br />

of settling civil disputes concerning financial settlements,<br />

ownership, health or fertility.<br />

B. No person shall refuse the reasonable request to assist the<br />

<strong>Association</strong>, its officers, committees or agents in locating,<br />

identifying and/or inspecting, or to answer promptly and<br />

truthfully any inquiry concerning an animal or ancestor thereof<br />

in his/her ownership or control, which has been registered or<br />

certified, or for which application to register or certify has been<br />

made. A violation of this rule may be grounds for disciplinary<br />

action.<br />

C. In the furtherance of his/her official duties, all <strong>Association</strong><br />

representatives shall be treated with courtesy, cooperation<br />

and respect, and no person shall direct abusive or threatening<br />

conduct toward him/her.<br />

D. All information furnished to the <strong>Association</strong> as a basis for any<br />

action by the <strong>Association</strong> or any of its officers shall be true<br />

and correct. This includes, but is not limited to, registration<br />

applications, application for show or race approval, and all<br />

information in regard to <strong>Association</strong> investigation of third<br />

parties.<br />

E. Accuracy of records furnished by the <strong>Association</strong>, either<br />

as hard copy or online service, is warranted by the PtHA<br />

only to the extent of using its best efforts in the compilation<br />

thereof and then solely for the benefit of the member or party<br />

purchasing the record. Reimbursement of the expense of the<br />

record on a showing of material inaccuracy is the sole remedy<br />

available to anyone receiving inaccurate information from the<br />

<strong>Association</strong>. Consequential damages are expressly excluded.<br />

No warranties, express or implied, arise from records<br />

issuance, other than as stated therein, as the purchaser<br />
