1. That person shall neither participate nor be eligible to<br />
participate in any PtHA-approved event. Nor shall such<br />
person be eligible to hold approved judge’s credentials or<br />
any other <strong>Association</strong> accreditation.<br />
2. That person or spouse shall not register any <strong>Pinto</strong> with the<br />
<strong>Association</strong>, or transfer registered <strong>Pinto</strong>s into his/her name<br />
or that of a spouse.<br />
3. No <strong>Pinto</strong> shall be registered which is either sired by a<br />
stallion or out of a mare owned by such person or spouse<br />
where the breeding date is shown to be on or subsequent<br />
to the date of disciplinary action.<br />
4. No <strong>Pinto</strong> which is registered in the name of such person or<br />
spouse is eligible to participate in any event approved or<br />
recognized by the <strong>Association</strong>, such as shows or races.<br />
5. Signatures:<br />
a. The <strong>Association</strong> shall not accept the signature of such<br />
person, nor such person’s spouse, nor that of such<br />
person’s children under the age of eighteen (18), on<br />
any breeder’s certificates, or stallion breeding reports,<br />
evidencing breeding taking place on or after the date<br />
of suspension.<br />
b. The signatures of the suspended person and that<br />
person’s spouse will be honored on transfer reports<br />
for the purpose of allowing such disciplined person<br />
or spouse to transfer <strong>Pinto</strong>s recorded in his/her/their<br />
ownership at the time of the disciplinary action.<br />
J. During the period of expulsion, suspension or denial<br />
of <strong>Association</strong> privileges, failure to comply with these<br />
restrictions and any other express conditions or restrictions<br />
of said disciplinary action may constitute grounds for further<br />
disciplinary action.<br />
K. Written leases filed with the <strong>Association</strong>, prior to date of<br />
suspension, covering <strong>Pinto</strong>s owned by the suspended<br />
member shall be valid, and the signature of the lessee shall<br />
be accepted during the time of such lease, but for no renewal<br />
thereof.<br />
L. Advertising<br />
1. No person on suspension, nor that person’s spouse, may<br />
advertise in the <strong>Pinto</strong> <strong>Horse</strong> online magazine during the<br />
period of his/her suspension, nor may that person’s name,<br />
nor that of his/her spouse, appear in any advertisements in<br />
the PH online magazine during the period of suspension.<br />
2. If publication deadlines or other factors make it impractical<br />
to stop advertising that is in violation of aforementioned L1.,<br />
this advertising will be terminated as soon as possible.<br />
M. The provisions of the disciplinary rules which pertain to notice<br />
and hearing procedure shall also apply to hearings regarding<br />
registration issues and other non-disciplinary matters.<br />
N. The <strong>Association</strong> has adopted the following provision for the<br />
mutual benefit of members and with the intention of reducing<br />
the <strong>Association</strong>’s litigation expenses, which expenses<br />
would ultimately be borne by members and non-members<br />
participating in <strong>Association</strong> activities. Every member, by joining<br />
the <strong>Association</strong>, or non-member, by purchasing <strong>Pinto</strong> horses,<br />
filing a registration application or other documents with the<br />
<strong>Association</strong>, or participating in <strong>Association</strong>-approved events,<br />
does thereby agree as follows:<br />
1. If unsuccessful in an attempt to overturn <strong>Association</strong><br />
decisions, actions, rules or regulations, to reimburse the<br />
<strong>Association</strong> for its reasonable attorney’s fees, court costs<br />
and other expenses in defense of such suit; and<br />
2. That he/she will not commence any action, whether in<br />
law or equity, against the <strong>Association</strong> in any courts other<br />
<strong>2011</strong> PtHA <strong>Rule</strong> <strong>Book</strong> 29<br />
