O. General Notice Procedure – Notice required by these rules<br />
and regulations may be served by delivering a copy of the<br />
notice to the person to be served, or his/her attorney, either<br />
in person or by mail, postage prepaid, to his/her last known<br />
address as it appears on the <strong>Association</strong>’s records, and upon<br />
mailing, such notice shall be deemed received by such person<br />
when it is deposited in the United States mail.<br />
B11. incorporation of Forms<br />
All <strong>Pinto</strong> <strong>Horse</strong> <strong>Association</strong> forms, as they may from time<br />
to time be supplemented, changed and/or amended, are<br />
incorporated as if fully set forth herein.<br />
B12. legal actions<br />
Every member and non-member agrees that he/she will<br />
not commence any action, whether in law or equity against<br />
the PtHA in any courts other than those federal and state<br />
courts located in Oklahoma County, Oklahoma, and further<br />
agrees for the mutual benefit of members and non-members<br />
and to reduce the costs and legal expenses incurred by<br />
the PtHA which would otherwise be borne by members and<br />
non-members participating in PtHA activities, in addition<br />
to any other sanction that may be imposed under these<br />
rules to reimburse the PtHA upon demand by the PtHA the<br />
reasonable attorney fees, costs and other expenses including,<br />
but not limited to, travel related expenses for Disciplinary<br />
Committee members, incurred by the PtHA in connection<br />
with any PtHA disciplinary action or proceeding, arbitration<br />
action or proceeding, court action or proceeding or other legal<br />
proceeding in which the member or non-member has been<br />
determined to have violated any PtHA bylaw or rules and<br />
regulations or has not been the prevailing party.<br />
B13. <strong>Pinto</strong> Charter Clubs<br />
A. Authorization<br />
1. <strong>Pinto</strong> Charter Clubs are authorized and supported by the<br />
PtHA for the purpose of advancing and promoting the<br />
<strong>Pinto</strong> equine, encouraging ideas of good horsemanship<br />
and good sportsmanship, and providing activities for PtHA<br />
members on a local basis.<br />
2. Charter Clubs must be approved and shall operate under<br />
the supervision of the PtHA through the PtHA Executive<br />
Committee and its Charter/Membership Committee.<br />
B. Establishing <strong>New</strong> Charters<br />
1. Submit a list of Directors, Officers and Committee<br />
Chairpersons. All Charter Club Directors and Officers are<br />
required to be members in good standing of PtHA.<br />
2. Submit a membership list of at least twenty-five (25) PtHA<br />
members in good standing. Include name, address and<br />
PtHA membership number.<br />
3. Submit Articles of Incorporation and Bylaws.<br />
a. A complete Charter Club guide with model Bylaws is<br />
available from the PtHA Business Office and may be<br />
obtained by writing the PtHA Business Office.<br />
b. Application must include a “purpose” which<br />
incorporates the following verbiage: “to cooperate<br />
with and aid in every way possible the programs and<br />
functions of the PtHA” and “to uphold the policies of the<br />
PtHA”.<br />
c. Articles of Incorporation and Constitution, Bylaws, and<br />
rules of each Charter Club must conform to the state<br />
or country laws of incorporation of organizations and<br />
must be consistent with PtHA Bylaws and rules.<br />
