either deliberately or unintentionally by the influence of drugs<br />

and medication.<br />

B. Prohibited Substances<br />

1. A <strong>Pinto</strong> shall not be shown in any class at a show<br />

recognized by the PtHA if the <strong>Pinto</strong> has been administered,<br />

in any manner, any prohibited substance. A prohibited<br />

substance is defined as any stimulant, depressant,<br />

tranquilizer or local anesthetic which may affect the<br />

performance of an animal (stimulants and depressants<br />

are defined as medications which stimulate or depress<br />

the circulatory, respiratory, central or peripheral nervous<br />

system). Also prohibited are any drugs, regardless of how<br />

harmless or innocuous they might be, which may interfere<br />

with the detection of the aforementioned drugs.<br />

2. The full use of modern therapeutic measures for<br />

improvement and protection of the health of the horse,<br />

including the non-steroidal anti-inflammatory drugs is<br />

permitted, unless the drug given also may stimulate or<br />

depress the circulatory, respiratory, or central or peripheral<br />

nervous systems.<br />

3. The use of medicinal preparations and tonics of any kind<br />

in which the ingredients and quantitative analysis are not<br />

specifically known, is also cautioned against, as the use<br />

of such may result in a positive analysis of the specimen<br />

taken from the horse.<br />

4. All owners, trainers and exhibitors are accountable for<br />

condition of any horse which is entered, or allow to be<br />

entered, in any PtHA sponsored or approved event. Such<br />

persons are hereafter referred to as “responsible parties”.<br />

By voluntarily entering a <strong>Pinto</strong> in any PtHA approved or<br />

sponsored event, the responsible parties are presumed to<br />

know all rules and regulations of the <strong>Association</strong>, including<br />

penalty provisions. Based on his/her accountability for his/<br />

her <strong>Pinto</strong>’s condition, all responsible parties are subject<br />

to disciplinary action any time a prohibited substance<br />

is detected at a PtHA approved or sponsored event,<br />

regardless of the reason the prohibited substance was<br />

administered, and whether or not the responsible parties<br />

had actual knowledge of the administration or presence of<br />

the prohibited substance.<br />

5. In addition to the “responsible parties” as that term is<br />

used in this rule, any person who administers, aids in<br />

the administration, causes to be administered, allows to<br />

be administered, or conspires in the administration of<br />

any prohibited substance shall be subject to disciplinary<br />

action. Such persons are hereafter referred to as “involved<br />

parties”.<br />

6. It shall be presumed that the sample of urine, saliva, blood<br />

or other substance tested by the approved laboratory<br />

to which it was sent is the one taken from the <strong>Pinto</strong> in<br />

question; that its integrity has been preserved; and that<br />

all the procedures of the collection and preservation,<br />

transfer to the laboratory, analysis of the sample and the<br />

report received from the laboratory pertaining to the horse<br />

in question are presumed to be accurate and correct<br />

reflections of the condition of the horse during the show<br />

in which the horse was entered. The burden shall be on<br />

the responsible or involved parties to rebut the aforesaid<br />

presumption in a hearing conducted by the <strong>Association</strong><br />

Executive Committee or appointed committee.<br />

7. A request by a PtHA representative or its designee to<br />

take a specimen of urine, saliva, blood or other substance<br />

for testing shall not be refused by any person. Refusal<br />
