Regulations for the Implementation of the Standardization Law chiarisce ulteriormente quali sono gli standards cogenti 149 . Inoltre, la legge prescrive che le imprese possono domandare la certificazione di qualità dei prodotti in base agli standards nazionali e settoriali già pubblicati 150 . Le predette norme, sparse nella Product Quality Law e nella Standardization Law, costituiscono la base normativa sulla quale si struttura il regime di certificazione di qualità in Cina 151 . Invero, tali normative risultano decisamente troppo statiche rispetto a un fenomeno in perenne e rapidissima evoluzione, specialmente dopo l’accesso della Cina alla mercato mondiale. sanitary requirements of industrial products shall be compulsory standards within their respective administrative areas.» 149 L’art. 18 della Regulations for the Implementation of the Standardization Law così recita: The following standards belong in the compulsory category: (1) standards for pharmaceuticals, food hygiene and veterinary medicine; (2) safety and hygiene standards for products and the production, storage and transportation and utilization of products; standards for the safety of labor and hygiene standards and safety standards for transportation; (3) quality, safety and sanitation standards for project construction and other standards for project construction that must be controlled by the State; (4) standards for the discharge of pollutants concerning environmental protection and standards for environmental quality; (5) important technical terms, symbols, codes and drafting methods in common use; (6) standards for commonly used methods of experimentation and examination; (7) standards for conversion and coordination; (8) quality standards for the important products which need to be controlled by the State. The catalogue of the important products which need to be controlled by the State, shall be fixed by the administrative department for standardization under the State Council in conjunction with the relevant competent administrative department under the State Council. 150 L’art. 15 della Standardization Law così recita: « With respect to products for which national or trade standards have been formulated, enterprises may apply to the standardization administration department under the State Council or agencies authorized by the same department for product quality authentication. Consapevole di tali limiti, il legislatore cinese ha successivamente emanato due regolamenti in materia: le Regulations of the People’s Republic of China on Certification and Accreditation 152 e le Regulations for Compulsory Product Certification 153 . Le Regulations of the People’s Republic of China on Certification and Accreditation danno innanzitutto le definizioni di certificazione 154 e di accreditamento 155 (capitolo I, rubricato “Principi generali”). Successivamente, il Regulations of the People’s Republic of China on Certification and Accreditation prevede che lo Stato effettua uno sistema di supervisione e gestione delle attività di certificazione e accreditamento 156 ; stabilisce le procedure e i requisiti per l’approvazione amministrativa per la costituzione degli organismi di certificazione, per l’approvazione delle regole di comportamenti di tali organismi e del personali di certificazione ed accreditamento, e stabilisce altresì le eventuali responsabilità e sanzioni per gli atti compiuti in violazione delle predette regole.
